Not unless the purchase was within the last 45 days. Most warranties on ebay are not valid, unless the seller is an authorised reseller of that product.
If the purchase was within the 45 days, and the payment was via paypal, you need to open a dispute for item not as described. You will be required to send the item back at your expense.
Failing that, you will have to either accept the sellers offer, or try a charge back with your bank if the payment was funded via credit card, but in that case, you will also be required to send the item back.
