I have liased with the seller. They are happy with the reolution and claim Ebay initiated the complaint not them.
Why am I being penalised for this rubbish?

ebay doesn't initiate the claim the seller does - Although this might happen "automatically" if they have an "open an unpaid item case after 5 days" or soemthing similar selected in their selling settings - although they can easily over ride it, or cancel the claim,
If I were you I would wait and ring customer support. If there is a trail of emails through ebay messaging showing you have been laising with seller and they have accepted a particular outcome, customer service will see this adn most likely ensure you do not get a strike against your buying history, even if the claim is not closed.
