closing a case to get a refund?

I ordered an item from interstate and the due date for delivery came and went. I meant to just contact the seller but ended up opening a case (haven't used ebay much since there were changes). The seller said the item is not available right now so I have requested a refund, which they are happy to do. Problem is they've told me I need to close the case before they can do that. Is this right? Sounds odd to me.

Don't close the dispute until you have the refund as you cannot re-open it if the seller does not send the refund.
