case against the item that it was damaged during shipping

I bought an item of eBay and it was damaged during shipment. The book was send through eBay shipping program so they are the person who posts it i understand. 

I have been instructed to open a case against the item and not against the sell and i at a lose as how to do it.

The book was brand new and has had something drop on it or placed on it during transit and has broken the spine of the book.

 

 

The book cost $26.15 USD more then the book is worth at $22.95 USD

 

so the question is how do i start a case against the book with eBay as the shipper ? And what case do i start e.g. damaged or return ?

Either way if a case is opened the seller will suffer a defect on their account.

 

Seeing as the book is usable and is not a collectable that will increase in value over time, personally I wouldn't be punishing a seller with supplying a good item and presumably in good time as well.

 

I think this is a case of sucking it up and let the seller know. The seller may even offer a discount on another purchase should you be interested.
