US baker told to make gay wedding cake

A US Civil Rights Commission has ordered a baker to make wedding cakes for same-sex couples, finding his religious objections did not outweigh the state's anti-discrimination statutes.

The unanimous ruling from the seven-member commission in Colorado upheld a judge's finding in December that Jack Phillips violated civil rights law when he refused to make a wedding cake for a gay couple in 2012.

The couple sued.

Phillips said the decision violates his First Amendment rights to free speech and free exercise of his religion.

"I will stand by my convictions until somebody shuts me down," he told reporters.

Gary marriage remains illegal in Colorado, but the state law prohibits businesses from refusing to serve customers based on their sexual orientation.

The couple who sued Phillips, Dave Mullins and Charlie Craig, were married in Massachusetts and wanted a wedding cake for a reception to celebrate their union back home.

The panel ordered Phillips to stop discriminating against gay people and to report quarterly for two years on staff anti-discrimination training and any customers he refuses to serve.

Phillips' lawyer said she was considering appealing the ruling.

I don't understand the problem.

Why didn't the baker just make the cake?

Why didn't the couple just go to someone who would instead of suing?

Why doesn't the baker have the right to refuse on the grounds of his beliefs?

Why is gay marriage illegal in that state yet it's illegal to refuse making a cake for an illegal ceremony? Huh? Double standards! The baker should turn around and sue the state to legalise gay marriage

And what constitutes a gay cake, anyway?

Probably just the topppers Icy, 2 grooms or 2 brides. I cant imagine anything else that would differ in wedding cakes for a same sex couple.

Sounds to me like too many people with too much time on their hands.

Probably what Lis says, also maybe with rainbow stripes or decoration?

Hardly worth suing though imo, just find someone who will do it, shouldn't be too hard.

personally i would just find a baker who would be happy to make a cake. i don't know that i would want or trust someone to make me something if they hated me anyway. yes the baker is a bigot but suing over something like this is ridiculous, the couple should be grateful they can get married in the first place, unlike us here in Australia

I agree with you Vampire. They should have gone elsewhere and I think their vindictiveness just puts them in the same boat as the baker.

Hhhmmmmmmmmmmm maybe its my middle class white girl with little to be discriminated against thinking, but I dont understand forcing someone who is clearly ignorant to do something. Pi ss and moan for sure, lead a boycott, whatever makes you feel better, but suing him and ultimately forcing him to make you a cake? I just dont get it. There is ignorance everywhere, you cant force them to change. Its like I tell the kids, there are 7 billion people on the planet and you can only control one of them, make it count.

why is the baker a bigot for having a different point of view/belief to homosexuals?.

why are the homosexuals not bigots for being of a different point of view/belief and

wanting to force these beliefs on every one else.?

So if I went to a bridal shop to buy a wedding dress and the proprietor refused to sell me one on the grounds that my fiance was Aboriginal and her religion disapproved of interracial marriages, would I be a bigot if I took her to court?

the world is very unfair. just the day before yesty i wished i had insisted that hubby comes with me to k mart. the experience (again) on the checkout with a couple of 6 foot neanderthaler men was not so nice.

this country turns me into a man hater slowly.

and if you went into a pub and were refused a drink because you were gay, would you just go somewhere else?

I think the issue here is whether, in the provision of services, discrimination on the basis of sexual preference is permissible.

If you go back in time 50 years, segregation was practiced in America and other parts of the world. Jobs and services were denied to non whites and non christians and gay people and women. It was a bad time to be anything other than a white male.

Many commentators are trying to trivialise this issue and make it about cakes. But the real issue here is discrimination against minorities. That is, is it OK to fire someone or deny them a job or a service because you disagree with their race, religion, sex or sexual orientation.

You would go elsewhere and then sue then for some $$$$.

But in all seriousness, the debate here is not about a cake but does religious rights supersede human rights?

The answer is no.
