Yes, definetely lodge a Paypal claim before the 45 days from purchase period runs out.

It is too long to expect a buyer wait another 5 weeks on top of the 5 weeks they have already waited for a working item.

What did the seller want you to do with the first non working one? Paypal will require you to send it back by trackable post to the seller I think.

Ipurchased an item from china and it took 5 weeks to get here and does not work. The seller has said they will send another one to me,but the lodgement time for a claim will run out before the item arrives,so should I lodge a claim anyway or hold out hope that I will recieve the resent item and it works. Thanks

Paypal do not always require goods to be returned to the seller.

From time to time they will take into account the expense to return - usually when buyer requests consideration of this, or a seller indicates they do not require return.

You absolutely must lodge a dispute with Paypal before the 45-day cut off period expires, because once it does, you will very likely not hear another word from your seller and there won't be a damn thing you can do about it. Unfortunately it's a very common MO of theirs.

How the hell did you pay for your item then? If it was with a credit card you can conceivably approach your FI with a view to arranging a chargeback, but if it was via international bank transfer than you have essentially done your money cold, and you'd better hope the seller sends you another one as he "promised" (although truthfully the likelihood of that happening is between zero and none).

In which case, I refer you back to my post #5 where I suggested that if you fail to lodge a Paypal complaint withing the 45-day period, once that period expires you're unlikely to ever hear from your seller again.

Speaking from experience.....

Lodge a claim with PayPal! Don't let the seller string you along until the 45 days are gone. It's an old trick. Once the 45 days have expired you'll never hear from them again.
