How can I get compensation from an item I bought on eBay for $500? The item stated the stickers were in "good condition" but they are in an appalling state; when I asked the seller to cover the replacement cost for a new sticker sheet he is refusing. I want to keep this item but I also want some compensation to cover the cost to replace the stickers which are $124.22 at their cheapest and I asked the seller only for $80, he is refusing to acknowledge that he delivered me an item that was not as described, instead insisting that it is despite photographic evidence and quotes from his item's description.

If you are within the 30 days after the last ETA of the parcel, open a case with eBay's "money back guarantee". You may not get to keep the item if the seller insists on a return of the lego set, but they do have to pay for the return postage.

Edit, it's also not a good idea to sell on the same account you buy on - buyers can easily see what you paid for items you've bought for resale.

Did you ask before or after leaving the red dot and comment?

Did you send photos to show the stickers are not in good condition?

I think you have to decide whether you want to keep the set or not.

You can definitely open a 'not as described' case but as padi said, if you win that, the seller could well opt to refund all money but you will have to send the set back. Seller would pay return postage, yes, but you would not get to keep the set.

I am not sure that you can force a seller to give you a partial refund. Some might do that to save the bother of a buyer opening a case against them, others might be just as happy to get their item back & resell. I think your seller sounds like he is in that latter category.

If the item you have is usually listed cheaper when in poor condition, you've nothing to lose by getting all your money back. Your decision.

Yes and yes, after exchanged many messages he is unwilling to acknowledge the undescribed damage... And I did 100% send photos with my initial message.

Wow, after leaving feedback like that for the seller why are you surprised that he is not being very co-operative?

You should have sorted it out before leaving feedback. Calling someone a scammer is not the way to get co-operation.

Never mind the "scammer" bit, calling someone an unnecessary word like "DISGUSTING", especially in capitals, is a big negative against the caller in my opinion. It shows immaturity and totally inappropriate aggression.

This feedback I left finally after many messages we exchanged, he was unwilling and rude, I had had enough. You shouldn't judge the situation when you don't know the full story.

The problem as i see it is you are expecting $80 compensation which is a really big chunk of $500, for what I am assuming is stickers that go on lego or some such thing ( I could not view item). So the stickers probably aren't even the main part of the item.

You say that replacement stickers are $124 but that is for new stickers and you bought a second hand item. The seller sees your request as blackmail. The question isn't how much new stickers would be worth but how much would the used stickers be worth on ebay? Not 'excellent' condition stickers either. Just second hand stickers in very average condition. Probably not $80.

It's hard to really judge things as we (or at least I) can't see the original ad or the stickers. I'll say this much. I've had times in the past when I have been mighty annoyed too, to find some sort of damage on an item I've bought that was not mentioned in the listing & not shown in any photos. Part of the trouble is words like 'good' are a bit vague.

Detail & complete disclosure are better in ads.

If you feel you overpaid, open an item not as described & probably get a refund/return the whole item. It's clear the seller isn't interested in a partial refund.

I wasn't judging the situation, I was judging the one sentence you wrote for the feedback "DISGUSTING seller SCAMMED me with FALSE item description; AVOID AT ALL COSTS!" which sounds overly aggressive. It's your feedback, your choice, it's not against any ebay rules, but don't then expect the seller to be nice to you. As others have told you here, either keep the item and let it go or open an ebay case and return the item for a refund (if you win).

Boardies can only give opinions on the information available to us when a question is asked.

Feedback and Feedback Left for Others is part of that information.

If you are going to come to the boards for help it is probably best to do so before leaving feedback which does tend to limit your options.

The seller could probably have that feedback removed.....words like disgusting and scammer are not allowed in feedback.

Yeah well thank you very much for your judgement over my feedback, mate. How I choose to describe the transaction is up to me and I simply expressed how I felt and warned others to stay away from this obnoxious seller's store so that this kind of thing doesn't happen to anyone else. Seriously, your input isn't helpful and you should probably stop there.

yep, inspect at pickup, mention any discrepancies in the item listing description, negotiate on the spot. No need for sending messages or photos if everything is sorted at time of pickup.

I’m confused about the price though. The Opening Post says $500, but the listing says sold for $600. Wondering if the price was negotiated down by $100 at pickup, OR, are they expecting compensation of $500?

elite, I am only raising these points so that we can get the full story. It is always hard to offer advice when information has to be extracted or is provided in a trickle down fashion.

I would expect that this is another buyer who thinks that a USED item is going to be in brand new, mint condition. Nowhere in the ad was mint condition mentioned. "Good" condition was and that generally means that its been played with and shows signs of wear and tear. Maybe the OP needs to read up on what the different "conditions" mean before unloading a heap of money.
