      <description>&lt;P class=""&gt;&lt;SPAN class=""&gt;Hey guys new to eBay . so I had a watch up for sale that I sold now I put the watch up for sale that was my late pops watch which due to circumstances I had to sell, now I took the watch to a place a couple years back and they told me what it was so only going off their info I’m no watch expert &amp;nbsp;now I put it up for sale/auction on eBay and had a guy message me asking for authenticity and paper work I clearly stated I didn’t have any hence the price so he was fully aware, also told him I took the watch to a place a couple years ago and am only going off what they told me, now the photos I posted of the watch are clear as day and multiple pics of watch, I also stated in my ad the watch had been sitting for a very long time and also before posting ad I put my returns as I do not accept returns, now buyer was fully aware of what he was buying, I sent the watch of obviously gave tracking numbers to him.&amp;nbsp;&lt;/SPAN&gt;&lt;/P&gt;&lt;P class=""&gt;&lt;SPAN class=""&gt;he later received the watch and took it to his watch guy they had a look and he said that the watch is a replica and doesn’t work and would like to be refunded.&lt;/SPAN&gt;&lt;/P&gt;&lt;P class=""&gt;&lt;SPAN class=""&gt;I spoke to him about it and clearly stated he knew I had no paper work for it hence the price, I had told him it had been sitting for a very long time also I don’t accept returns, once the watch is sold it’s not my responsibility, now I know if I was in his shoes I would feel the same way but he knew what the risks was when buying this&lt;/SPAN&gt;&lt;/P&gt;&lt;P class=""&gt;&lt;SPAN class=""&gt;watch.. also I did not know the watch was a replica I was only going off what I was told, I’m know expert and didn’t have time to get it checked out, if I had of known it was a replica it wouldn’t have been sold!&amp;nbsp;&lt;BR /&gt;How do I come about this situation?i?&lt;/SPAN&gt;&lt;/P&gt;&lt;P class=""&gt;&lt;SPAN class=""&gt;Now I have offered&lt;SPAN class=""&gt;&amp;nbsp; &lt;/SPAN&gt;to give partial refund the whole amount I got after gst, he then said no he wants full amount I’ll be out of pocket then, will eBay refund me the gst or what is the go? &lt;/SPAN&gt;&lt;/P&gt;&lt;P class=""&gt;&lt;SPAN class=""&gt;Now I’m new to eBay and am only trying to understand and resolve this problem the best I can, where do I stand with this situation as everyone says customer is always right supposedly but as a seller do I have the right to refuse refund, partial refund fair enough?       <description>&lt;P&gt;"No returns" only applies to "change of mind" returns not for "not as described" returns.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;So you have to accept the return and pay for the return postage.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I hope you don't get scammed with this where the buyer sends back a different watch.&lt;/P&gt;</description>

      <description>&lt;P&gt;You sold it as a Rolex Submariner – whether it is or isn’t, he says it’s not and you must accept the return.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;You feel the watch is genuine. Do you want it back? If not just refund him in full and that will be the end of it.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Say you do want it back. Has he started a INAD dispute through eBay? If he has, go to the dispute and accept the return. If you can (and I have no idea whether you can or not) put insurance to the value of $4000 on the return postage label – and please make sure you choose the Australia Post label option. If he starts the dispute and you DON’T provide the return postage label, eBay will take the refund money from you anyway, and you will also lose the watch. If you want the watch back he must start an eBay Dispute – do not deal with him outside of eBay.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Unfortunately you did not provide a photo of the important part – where the serial number is located – so if you have got yourself a shonky buyer, and he does return a different (replica) watch, you will have no way of proving it.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;If you are lucky and you get your watch back, take it to a local auction house and ask them to sell it for you. They will quickly tell you whether it is a replica or not; and if it is real, they will get the appropriate price for you. Sadly this could be a very expensive lesson for you; but do try and make your losses as small as possible. Good luck.&lt;/P&gt;</description>

      <description>&lt;P&gt;I am no watch expert so am only going off someone else's information but the two things to look at are the number 1 in the date code and where it says swiss made. Compare these to an original and you can see a difference.&lt;/P&gt;</description>

      <description>&lt;P&gt;Same here bricks, I'm no expert either&amp;nbsp; but there are&amp;nbsp; plenty of differences in a real and&amp;nbsp; fake Rolex .&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Even something as subtle as an ever so&amp;nbsp; slightly different clasp could make a difference&amp;nbsp; if / when&amp;nbsp; comparing the&amp;nbsp; returned watch to the photos.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Although we all know which way these&amp;nbsp; disputes usually&amp;nbsp; go,&amp;nbsp; so wishing the OP good luck&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;</description>

      <description>&lt;P&gt;The one thing that keeps jumping out at me is the whole "no returns" codswallop.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Every last seller on eBay accepts returns - like it it not. Just try dudding a buyer by inaccurately describing your item, and you most definitely accept returns every day of the week. Nobody ever gets to say... "well you bought my trash so sucked in you're keeping it"... can you imagine the state of our society if that were the norm - or even tolerated on any level?&lt;/P&gt;</description>

      <description>&lt;P&gt;I read your ad. Nowhere there did you give the slightest indication that this might not be a genuine watch or that it didn't work. I cannot for the life of me understand why you did not at least test it to see if it worked before you put it up for sale. And as for your claim that 'you didn't know if it was a replica or not', that is really dishonest form to advertise it as the real thing at such a high price point if you weren't sure.&amp;nbsp;&lt;/P&gt;&lt;P&gt;You would have been better to put all the details in your ad so buyers could decide whether to take a risk or not.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;The basic situation is this. On ebay, a buyer only has to say something is &lt;STRONG&gt;not as described&lt;/STRONG&gt; and they are likely to win a&amp;nbsp; claim. This man doesn't have to prove whether it is Rolex or not. All he has to say is it is not working. You advertised it as an exceptional piece ensuring &lt;STRONG&gt;reliability&lt;/STRONG&gt; and style.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Ebay isn't like the old days, you don't get to decide who you will refund or how much etc. These days, ebay steps in in disputes. Once an item is sold, yes, it is still your responsibility till the item is received and the buyer is satisfied it matches the ad.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Let the buyer open a dispute, then you issue a proper return label &amp;amp; you will have to refund in full once you receive it back. Cross your fingers, because unfortunately you have sold in a category where you have left yourself wide open to being conned. You look to be new to buying &amp;amp; selling on ebay, you have an expensive item, you don't have proof it was genuine etc. Some dishonest buyers target people like you. Let's hope that isn't the case here.&lt;/P&gt;&lt;P&gt;If you must sell on ebay in future, start with low cost items.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;</description>

      <description>&lt;P&gt;It belong to dad so one could say it's a&amp;nbsp; 'vintage' submariner. Prices on the web, for a working vintage Rolex submariner range from $35,000&amp;nbsp; to $50,000. There is one available for $500,000 but I attribute that to wishfull thing.&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Your buyer would have be aware of:&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;1) The high value of&amp;nbsp; a genuine vintage submariner&lt;/P&gt;&lt;P&gt;2) The even higher probability it is a copy watch&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;The thinking would have been if I buy it and it's genuine i can onsell it on the cheap for a quick $20k return,&lt;/P&gt;&lt;P&gt;and/or&amp;nbsp; get the $4000 back as ebay will refund it, no questions asked.&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;There's&amp;nbsp; only one conclusion.&amp;nbsp; What will be returned to you will be a copy watch&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;</description>
