      <description>&lt;P&gt;i received my first&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;'buyer requested a return' yesterday for a second hand dvd they have said under Reason- 'i found a better price elsewhere'&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;and then under comments- 'i have not received the dvd'&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;sounds like a crock to me&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;i do have no returns on my listings so will i be made to refund if i say no? im so confused by these new rules i dont know what to do&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;thank you for any advice&lt;/P&gt;</description>

      <description>&lt;P&gt;As I understand the new rules you do not have to accept a return for refund if the stated reason by the buyer is a change of mind.&lt;/P&gt;&lt;P&gt;But you do have to if the reason is item not as described or not received.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Seems your buyer has given two reasons here. It will be the not received one you will have to deal with.&lt;/P&gt;&lt;P&gt;If they claim not received then you will have to provide proof of postage to argue your case.&lt;/P&gt;</description>

      <description>&lt;P&gt;These concerns and uncertainties sound so familiar to me.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Over the years I've had a number of return requests and especially recently, I have agreed, simply because I didn't feel like fighting either the buyer or the system.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;The other day, I had already received pos feedback from a buyer and a few days later, a return and refund request, as the buyer found the item did not fit them.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;On this occasion, I decided I would send a polite,simple and straightforward refusal to refund. I stated only that I do not accept refunds for sizing as I provide accurate measurements in the 'Size' section of my description in every listing.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I then waited, slightly shaking in my shoes, to see what sort of response I got to that. So far, nothing.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Hope that means that the buyer has accepted my response and moved on, but of course they still have other options, should they decide to use them. I'll have to wait a good long time to know that I'm in the clear on that one, since buyers have so long to apply for returns and refunds these days.&lt;/P&gt;</description>

      <description>&lt;P&gt;How long ago did you post it? I'm wondering if they've watch the DVD and now want to return it because they don't want/need it any more. Wouldn't be the first time. Maybe they didn't like the movie. Some sellers have received negatives because the buyer watched the movie and didn't enjoy it.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Before these new rules came in, I said I'd hate to be a seller of clothing or DVD's. I can't help but think they are going to cop it the worst as far as extended returns go. Buy the movie, watch the movie, have the t-shirt, no longer need it, so send it back. Same with clothes. Buy the outfit, wear it to the function, can't possibly ever wear the same outfit twice, so send it back.&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;As mentioned, contact the buyer and see which option is the case for them, but it does sound a bit sus.&lt;/P&gt;</description>

      <description>&lt;P&gt;TBH I still think it sounds like they may have selected the wrong option in eBay to open an item not received case.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I wouldn't be confident that opening an incorrect case and selecting particular options is "admitting" they received the DVD.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;In their message in the case you indicated that they wrote they did not receive the goods.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;eBay should remove the defect and negative feedback though.&lt;/P&gt;</description>

      <description>&lt;P&gt;I still dont like the selection options of&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Defective or does not work.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Have had the odd claim on this after they have crashed&lt;/P&gt;&lt;P&gt;or brocken and used the odd toy.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Thats what warranty and guarantee is for, not&lt;/P&gt;&lt;P&gt;too mention spare parts and repairs.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;In the fair trading legislation, it states items faulty&lt;/P&gt;&lt;P&gt;through use abuse or misuse are not covered&lt;/P&gt;&lt;P&gt;under warranty or guarantee and items faulty that&lt;/P&gt;&lt;P&gt;have damage(of any sort) are not covered under replacement or refund&lt;/P&gt;&lt;P&gt;but only eligable for warranty repair.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;It is not meant to mean you get your money back&lt;/P&gt;&lt;P&gt;because you busted it or because something&lt;/P&gt;&lt;P&gt;failed, Australian law allows for repairs unless&lt;/P&gt;&lt;P&gt;something major is faulty.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;In the case of hobby products, nothing is major,&lt;/P&gt;&lt;P&gt;all is repairable.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Doesnt stop people hitting that return button tho.&lt;/P&gt;&lt;P&gt;Luckily I dont sell much in ebay like I used to&lt;/P&gt;&lt;P&gt;nearly 9 years ago now.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;</description>
