Question Paypal Buyer Protection - Yeah right! in PayPal & Payments

This gripe refers to something I purchased on another online site but thought I would share it here as well.

I made a purchase and upon receiving it, discovered the item was damaged, it was a new item. I complained to the seller who had not answered my emails so decided to raise a Paypal dispute. The item was posted back to the seller with tracking.

Now this is what the Paypal site says buyers are protected for with purchases:
- You received a completely different item.
- You purchased two items, but received one.
- The item was damaged en route to you.
- You bought the original, but received a counterfeit.

On reading the status in the resolution centre this is what it says:

"We're unable to decide this claim in your favour at this time. PayPal's Buyer Complaint Policy applies to the sending of goods but not to disputes about merchandise quality."

So much for buyer protection on receiving a damaged item!

I will add that after another dozen emails the seller did finally refund, but as for Paypal's Buyer Protection - hmmmmmm!
