A compound bow that fires steel balls
I paid $315 for a compound bow from china that fires balls. They sent me the attachment and not the bow! Now the attachment is worth say $80. I paid for the device In the picture. False ad! Can the ACCC step In and make either Ebay refund my money or make the seller provide the bow as advertised , or am I wasting my time? Does EBAY have to live by their policy of ;We guarantee you will get what you purchased or your money back? I am absolutely On FIRE!!!! Am I wasting my time?

OP3 years agoI of course lost the battle. I just want to know what bow is used for that device. By the way 30 day returns are not for overseas orders and some I have heard the return date has to be activated in 3 days! Not 30!

·3 years agoWell you are totally wrong there, the 30 days applies to all items listed on eBay AU - apart from a few exceptions.
Read the MBG policies again !

·3 years agoOP, repeating something that is not true - no matter how many times it is repeated - does not convert it to truth.
You misunderstood the listing; the mistake is yours. You are upset at not getting what you thought you were getting, but as the seller did include details in the item specifics to clarify that the item being purchased is the launcher only, not the bow, you are not able truthfully to claim INAD/SNAD.
I would say the listing might have the potential for a buyer to find it a bit misleading because the main (first) image is not of the launcher, but rather of a compound bow plus the launcher. However, you won't get a refund on that basis, because the seller did include a photo that specifically showed what was included and what was not included. You just didn't read the description in sufficient detail.
RED FLAGS YOU MISSED
Your seller's feedback is terrible. 98.2% - run away! And registered in China... with no excuse for you to think it's a seller based in Australia since the listing shows the item as coming from the Chinese mainland.
Also... a compound bow of the sort shown with the launcher isn't something you'd be able to buy for that price - and for a good quality one not designed for beginners / entry level junior archers, you'd be looking at rather more. $800 and upwards, surely, and at the top end it's a lot more still.
Bottom line: read listings carefully and don't buy from sellers with such poor feedback. For high volume sellers with feedback percentage less than 99.5%, caution is advisable. For precision items of this sort, I would really suggest sticking to a good quality brand sold in Australia.

OP3 years agoOk EVERYONE! The ad Is misleading first of all. The launcher sells for less than 100$ on other sites/sellers. I have put In a complaint to ebay sayin that I did not get the item as described or In the picture. Thirdly after I made a complaint to ebay, the seller sent a message saying they had changed the delivery option. Even Ebay agreed several times that the ad is misleading and they will be put on notice. I got a reply from them quickly after launching a complaint. Either way I want the bow or a refund. I know there are 2 side's to every argument but I am not paying $315 for a launcher when the bow is what you see In the advertisement. I see something I like, I buy It. They have changed their ad by the way!!! Item number ;185615265505! Or Ebay can refund me and they get some bad feedback, End of Story.

OP3 years agoThe problem Is that they/the seller did not give me the bow, full stop. So the picture of the item Is not what you get. It Is too late to open a claim because of the time I have wasted talking to the seller and 2 days talking to ebay! I have no bow. The seller walks away with my money. There Is nothing I can do past a certain date. I should have been quicker resolving The matter. I should not have given a positive feed back!

I did what someone told me and started a ebay resolution or to say item not received. % minutes after I did that the seller sent me a message saying they have changed their item delivery. It sounds like they are going to send it,but we shall see!

You are NEVER going to get a compound bow - that's not what was advertised.

But just looking at some of your purchases you do like buying from sellers with bad feedback. Even one that constantly sends the wrong item. The one with the bow may not have being one of these but it does show that you are asking for problems.

·3 years agoI suspect you've dealt with a seller that knows exactly how to play the game and uses it to go past the MBG timeframe.
You can always leave follow-up feedback for them, which although not perfect will still show on there feedback, and possibly warn other buyers if they are diligent.

·3 years agoIf that is the listing in question, then even if they were still within the timeframe, the OP doesn't have a leg to stand on. Look at the 4th photo....
"Caution: this product is the main product. Bows need to be purchased additionally". It's quite clear in several areas that the listing is for the ball launcher, not for a bow. They can cry all they want, but a bow was never included in the price.
OP, you need to read ads better or you will keep thinking you're being ripped off. Read the ad, don't just look at the main photo, especially when listings are in Chinglish.

·3 years agoIf that's the one the OP bought GP then that would explain why they wouldn't give the item number, obviously they bought the launcher and not a bow at all.
The listing is a bit deceptive in my opinion, in that it shows the bow but unless you read the listing carefully you could assume you would be getting the bow itself. I note they don't appear to even sell the balls to fit it.
I also haven't seen so many listing changes ever....................
I wonder if you could use harp strings on that bow ????? 🤣🤣

·3 years agoHi Padi, Yeah the seller could have a different pic as the main pic, but also the buyer should not go by a single image, when multiple images are provided.
I probably viewed more listings than the buyer on this one. Most have similar main pics, some are multi variation listings, some use superimposed images, etc.
Most also include Fit for, as I highlighted. Others also include what your bow needs to be compatible etc.
Just received a discount offer for this item, simply for viewing, which might explain the OP,s purchase price.

OP3 years agoHi. Not only that they changed the original add. The item number was 185615265505. i put in a ebay complaint and 5 minutes later the seller sent me a message sayin gthey have changed their delivery details. that may mean I am getting the bow. We shall see! thanks

Anyway, I am going to buy this one(185730626536) from the same seller (only $15.39)
And then I am going to make a claim for INAD. So what do you think my chances of winning
and getting a bow included are.

·3 years agoYou have clearly stated here in this thread that you received the launcher that was advertised in the listing. Read the listing again - that's what it clearly states - there is no bow.
You had better hope and pray that the seller or eBay doesn't get wind of this thread, or you're going to be in all sorts of trouble with opening a false dispute.

·3 years agoI wouldn't expect to buy a usable, new, compound bow with any attachments for $315.
If I got one for $315 including possibly illegal attachments, I would make sure all my insurances were up to date.

OP3 years agoyes. Well I don't care what the seller thinks. It is false advertising and 5 minutes after putting in an ebay complaint the seller sent a message indicating they have changed their delivery option or something. Either way Ebay has to refund if the bow does not turn up!

·3 years agoI wasn't going to come back here, BUT a word of warning, this is a public board i.e. anyone can see it.
So that means anyone can report this post to either eBay or the seller, if that happens eBay will close the dispute against you.
On top of that eBay can stop you from ever accessing the MBG because you have opened a fraudulent dispute.

Which one was it?
I do hope it was for item not received, because the seller can provide tracking that shows delivery and you will lose.
You will not get a bow and you will not get a refund in either case.
Simply because you haven't read the listing in it's entirety.

·3 years agoYes, the do have a policy of 'get what you purchased or your money back', but it isn't as if they monitor everyone's parcels. The only way they will know you didn't get what you purchased is if you open an ebay claim and as others have said, for item not as described, not item not received.
But first go back, have another look at the purchase details and double check your facts, that you did indeed order and pay for the complete bow.
If you did, then follow the links given earlier in this thread and make a claim. You don't need to 'speak to ebay' or go on chat, you can open the claim from your 'My ebay' section, it is all automated.

·3 years agoHi there, There seems to be quite a few adapters on the market, for well in excess of $300 compared to your estimate of $80.
Does the listing you bought from state that the bow is included or does it have something like Fit for compound bow etc.
There are also a number of multi listings available, where the high price for complete kits including bow range to excess of $1000.
In any event, as you bought from China, ACCC does not apply. While you may be able to make a claim via ebay, it will be very dependent on what the listing actually states and what you actually purchased.

But you put in a deceptive claim, as you did receive the item, but claim you didn't receive the item.
I know Ebay do read here (but never respond), please Ebay sanction this buyer.

If you open a case for Item Not Received the seller will show tracking and you will lose.
Do not close the case until you are happy with your refund, no matter what the seller tells you.
As soon as it shows, ask ebay to step in and resolve the case.

And I doubt the bow would even get through customs in any case
Yes, eBay do stand by their policy IF the buyer follows the policy of opening a dispute

It does'nt 'just happen'
It's not up to the seller. if you did not get what the ad stated , the seller has no say in anything

·3 years agoSandy, compound bows are legal to own or buy online in all Australian states. Whether one that fires steel balls is, is not so clear as slingshots are illegal in some states.

·3 years agoI got done for having a simple sling shot. It had been hanging on the laundry wall for 20 years. We all had them as kids. Made our own.
Personally, I think someone who wants a bow to fire steel balls shouldn't have it passed by customs. JMO. Sounds like a weapon that could cause death or serious injury.
OP should go for a refund under Ebay's MBG

·3 years agoThe designed projectile for a bow, an arrow, by definition can cause death or serious injury. Even with field tips, injury is a distinct possibility.
Compound bows are generally designed for hunting game. I'm sure the pig I got once thought it caused death.
I wouldn't buy a bow simply to emulate a slingshot, though.
