The item sent was the wrong one on 18 November 2022 and I have been trying to get it changes since then.
I have sent about 30emails and just get the same response each time ( See below) I am at the point I don`t know what to do from here. I just want the item i ordered or a refund. Thats what I have requested 30 times

·3 years agoRather than send 30 emails , you need to follow the correct process (as has been explained)
You don't get to do your own thing and expect to be covered
eBay give buyers all the tools they could need to cover themselves
The time to 'make a complaint' through eBay is long gone
After you sending 30 emails with the same response, did'nt at some point suggest they were automated bot replies you got to all those emails?

When things on ebay go wrong, turn to the help pages to read about what to do. Just sending messages to the seller over and over wasn't working so after the first two or three times, you should have known another solution would be needed.
You don't need to contact the seller at all, in fact.
If something doesn't arrive, have a look at the expected arrival date. I suspect your item was on its way from China. So okay, probably due about mid Dec.
If it didn't arrive by then, that is the time to open a claim in ebay for the non arrival of the product. You don't even have to let the seller know you are doing it. Ebay will inform them and they will need to show proof to ebay that tracking showed it as delivered or else ebay will give you, the customer, a full refund.
Ebay does the refund, out of the seller's funds.
This seller is fobbing you off, safe in the knowledge you obviously don't know what to do. Surprise them, if you can, by opening a paypal claim.

All you needed to do was to open a return/refund request within eBay no later than 30 days after the ADD (Actual Delivery Date).
It’s far too long to do anything about it now - at least, within eBay.
If you paid through PayPal, you have a longer timeframe; 180 days from the date of the transaction. If your transaction (the date on which you paid) was less than 6 months ago, you can still open a request (PayPal Buyer Protection). Then contact PayPal by phone and explain that you foolishly did not act under eBay’s Money Back Guarantee in time, being unaware of the timeframes and correct procedure. Explain that you contacted the seller many times. Explain also that the seller is overseas. Domain in addition that the cost of tracked international postage would not be commensurate with the item price. Then plead, beg, etc, with a request that PayPal waive the requirement to return the item but that they will refund you without the need to return.
PayPal used to offer returns postage cover for Items Not As Described but have recently ceased doing so, so your only hope of avoiding your being out of pocket for postage cost is to make the request as above.
In future, you should not let things go like this! You must open a refund request in eBay immediately if the item is not as described (if the seller doesn’t respond with a solution within a few days (4 days at most).
