Seller never sent item. International item UK to AU.
They lied and marked it as sent untracked (to hide the lie). Item listing did not state as being sent untracked. He has form for not posting out items.
Waited the 3 weeks until due date had passed.
Put in claim last week for item not received and requested refund on the claim
as not prepared to wait any longer.
Seller rushed to post office within an hour or two of receiving the claim and posted the item tracked.
He had been asked for a refund both on the claim and by messages from me, which he ignored.
Item now in Australia which took a few days.
Ebay system has now refused to refund even though the extra few days he had after the due date, has passed. Ebay has now put the case on hold and has extended the due date because tracking shows the item is on it's way, which it should not have been because the claim was for a refund because he never sent it in the first place and I don't see why he should get the business having never sent it and lied about having sent it.
Now been told that I have to wait for the item to arrive up to the 14th March (new due date). How is it possible that the seller can just lie,, not send the item, ignore the claim for a refund, sent the item 3 weeks late after lying that he sent it and then Ebay ignores it's item not received guarantee and just extends the due date to accommodate the liar. And worse, I have to send it back by refusal to accept delivery which takes up to 3 months to be returned as it's a low priority for Oz Post. Plus I will have to wait up to a total of 4 months from original purchase date to receive a partial refund less GST and outbound postage for an item he was told not to send.
How is any of this fair or right?
I can't get to speak to a supervisor in item not received escalations despite spending 9 hours and about 30 phone calls trying to get past their guard dogs in their call centre.
Thanks for my 15 year loyalty they tell me every time I call up, but the one time I need them to help me they just shout me down to shut me up.
I do not know what to do now that won't end in my being out of pocket by sending it back and that lying snake getting away with gaming the system.

·1 year agoI'm thinking you might have left negative feedback without first giving the seller opportunity to sort the matter. Once the damage is done a seller has no reason to be helpful.
id43564
OP1 year agoNo, the feedback was left long after he was able to do anything about this, all of which was deliberate on his part. Please don't try to put the blame for this on me, it would be grossly unfair.
My feedback to him:
"One of the worst sellers I have ever dealt with. Lied and said he sent it international untracked (didn't state untracked on the listing). Turns out he never sent it. Waited nearly a month until the due date. Put in a claim for item not received with a request for a refund. Also told him I wanted a refund as I wasn't prepared to wait any longer and despite this he went ahead and sent it a few hours after the claim for item not received and request for refund was received by him. AVOID AVOID."
He then went on to delay responding to the return case until 30 minutes before the deadline expired.
He then deliberately sent a fake return label.
He then lost the case, had to pay a full refund and forfeited the items.
The whole thing took about 6 weeks to sort out from the date of ordering.
Every step along the way, his behaviour was calculated to break every rule he could and you somehow try to pin the blame on me?....get real.
id43564
OP1 year agoYou reckon that my feedback meant that he wouldn't have sent a fake return label??? really??? and why is that???? Do tell. And I 'm just dying to find out how you would have stopped someone from marking an item as having been sent when it wasn't and to hide that lie, marking it as untracked?
Do you have xray specs that can tell that an item is not in fact on it's way to you?
So how etb312, would you have stopped him from not sending it and by lying and marking it as sent untracked?
You reckon you are so f'ing smart....tell me how you would have stopped that from happening and how leaving feedback after the thing was eventually in the air when it shouldn't have been because he ignored the case which contained the request to refund, how was I supposed to have stopped that??? Got into my Superman costume and spun the world backwards so as to reverse time and the item gets sprung back to f'ing Bradford.
Get lost etb312. This seller deliberately put me through hell right from the start and if you had bothered to read this thread, you would know that.
id43564
OP1 year agoI'm waiting etb321. You clearly didn't get from this thread, that I'm not one to give up.
You picked a fight with me. You tried and failed to publicly ridicule me. Well come on, you want to fight....where are you etb321-troll?
Nothing to say??? including an apology??? thought not...coward.
id43564
OP1 year agoOh and before you decided to cast your aspersions against me, you could have taken the trouble, as others have done on this thread, to look up the item number and there you would have seen my feedback and that it had clearly been left at a stage where your comment was rendered redundant and totally inappropriate.
But oh yes, it's just so much easier to lazily troll some rubbish to make yourself look big.
Still waiting etb321.....you wanted to fight, so where are you???
id43564
OP1 year agoFor anyone reading this having similar issues, here is some guidance gained from my experience:
1. Do everything via the chat system. You need written records of what Ebay has said. The phone service is abysmal and you are unlikely to ever get a call back from a supervisor. Keep all chat transcripts, which Ebay will email you.
2. Chat will look at the messages between you and the seller whilst you are in chat....make sure that you make every effort to have shown yourself to be as informative and pro-active as you possibly could be. If there is nothing or very little from you in chat, that will go against you. If there is plenty from you but little or nothing from the seller, that will go against them. Might not change the outcome but it's good to do everything correctly if you can and this seems to matter to Ebay more than I thought.
3. Ultimately Ebay has strict rules on how a case proceeds and no amount of incredibly bad behaviour by the seller throughout the purchase and subsequent case, is going to mean that Ebay will over-ride the case in your favour before the hold is over. If they say that the case is on hold, even if it means that the seller just has time to mess you around even more, you just have to wear it and wait for each hold period to close. Ebay cannot do anything about it and believe me, I tried.
4. Above all, as the regulars on here keep telling people.....whilst Ebay encourages the two parties to sort things out between them, only ever try that for a day or two and certainly never close to an expiry date for you to open a case. Open a case very shortly after item not received by the due date/item not as described/arrived DOA and then vigilantly stay on top of that case and NEVER allow a seller to bs you or persuade you not to open a case...they are likely stalling until it becomes too late for you to open a case.
5. Check the seller's location in their About page. If it doesn't match with the item location, check their negs and neutral feedbacks for something like "item was supposed to be located in Sydney but came from China and took forever to get here". Many sellers in China actually do have items in Australia at warehouses who send out on their behalf, nothing wrong with that. Just be aware of the difference between the two types of sellers in China.
6. If you must buy directly from sellers in China and know that to be the case, then have a look on AliExpress for the exact same item, same pictures etc, which can often be cheaper with quite possibly the same sellers as on Ebay. You can pay with PayPal so you have the usual guarantees from them.
7. Read the neg and neutral feedbacks before buying and choose the seller with the highest percentage (above 99% if possible) anything less than about 98% keep looking if you have alternatives.
High numbers of negs in the last 12 months should be an instant warning to you, even if they are for high volume sellers.
If there are even a few comments along the lines of "they never answered messages, very difficult to communicate with" walk away because they will likely do the same to you if there is an issue.
id43564
OP1 year agoEvidently when creating the postage label, the seller deliberately fudged his UPS account by entering my address but did not change the origin country. I think that he had hoped that the UPS system wouldn't detect that and so he would get away with buying a much cheaper domestic label. The giveaway from the start was that there were no customs forms in the email with the label. A quick call to UPS and they confirmed the whole thing.
The seller had until today to send either the return postage cost or a valid return label.
In the words of Neville Chamberlain (sort of): I have to tell you now, that no such undertaking has been received and that consequently Ebay have closed the case in my favour and has provided a full refund; paid for by the seller out of the funds on hold.
He will also forfeit the items.
Thank you to everyone for all your kind support and help....much appreciated.

·1 year ago👍 I really hope that’s the end of it
id43564
OP1 year agoI can't see how it couldn't be the end of it.
I notified the seller via messaging of the issue with the label and that a UPS label can't be used at this location.
That was days ago so he/she had plenty of time to send the postage cost which I also evidenced by a photo of the AP system showing the cost at the PO.
Ebay/PayPal have now issued the full refund and the case has been closed in my favour.
If he appeals, that's up to Ebay to deal with, not me....the refund has been issued and from what I understand, can't be reversed.
He didn't send a way to return the items within the deadline and worse he tried to use what appears to be a deliberate invalid label and having been quickly notified, did nothing to correct it, which proves it wasn't a mistake.
He didn't send the items until after the due date and after the item not received case was delivered to him, having lied from the start by marking the item as having been sent untracked.
In every possible way, I can't see how he has grounds for appeal, let alone for it to be granted.
And in any event, it is no longer my concern, thankfully.
springyzone
·1 year agoYou got the full refund, that is great news!
I did wonder if the seller was just trying to fob you off and hoping you would somehow let things time out as return postage from Australia would probably not have been cheap.
I think you are right, once ebay closes a case and refunds a buyer, that is the end of it, for you.
Should a seller appeal and win (which has been known to happen) then ebay would possibly pay back out of their own funds. Of course they don't like doing that and I doubt it happens that often. It does happen occasionally-doubt it will in this case as the seller didn't comply with the time lines-but even if it did, it would be ebay's worry, not yours.
Your post has cheered up my evening. Glad to see a seller like that lose out.

OP1 year agoJust asked chat if Ebay will cover the fuel cost of the 80kms in travel to go to the PO twice....no deal.
Although I think AU consumer law states that in this sort of situation, the buyer should not have to suffer any associated expenses when returning an item.
....and frankly Bradford is not a place I ever want to visit. A total dump. At least I can rest assured that his karma has already provided him with a lifetime of suffering by living there.
Chat told me this morning that this sort of case is very rare. I asked him, "so if this case is unusually awful....then why is he still able to sell on Ebay?"

OP1 year agoI think that providing an invalid return label (which UPS told me this morning, was highly unlikely to have been a mistake) has not gone down well at Ebay, judging by their change of tone today. It is in direct contravention of Ebay's rules. I think he has lost any sympathy he may have had up until now and they are now very clear about the refund whereas before it was mostly just "we will take action" with the occasional agent mentioning the word refund.

OP1 year agoThanks for that.
It seems, barring any more conjuring tricks involving sleight of hand and further devious knowledge of the Ebay procedures and rules, which even you good people haven't seen before, there may be light at the end of the tunnel.
He can't get out of paying for the return (if he wants it back).
If he does arrange to get it back, he can't make any deductions and has no real chance on appeal.
I think that all that he is now holding in his hand of cards, is the ability to delay sending the return postage until the 17th, then delaying the refund until the last minute. To do so after all this, shows what a petty, small-minded person he really is.
He also does run the risk of Ebay taking action against his account and for what benefit, I really don't know.
id43564
OP1 year agoParts of this evening's chat:
"We have our Specialist team who will thoroughly review the details and seller's selling practices. An appropriate action will be taken against the seller if we encounter the seller is violating eBay policies for their own advantages. The action maybe temporary restriction or permanent suspension of an eBay account." "We take this very seriously. I can assure you that when these incidents happen, we always work as quickly as possible to investigate and make sure eBay is a safe and reputable place to buy and sell" "Be assured that necessary action will be taken on then and their account once investigation is done". "I have also raised complaint and reported this seller so that this can be investigated on priority".
id43564
OP1 year agoEbay UK and Ebay AU seem to have the same policy of not allowing members to send an email address via their messaging system and will block or change the message to not include the address. I assume that the seller knows that already so this appears to be yet another delaying tactic.
I asked chat earlier today to suggest an alternative and he could not provide one. I was told on the phone by escalations today, that if I don't provide my email address to the seller, the case will be closed in the seller's favour.
This is getting absurd.

The policy says that email addresses sent via messaging are changed to an Ebay address so no doubt he plans to use that as an excuse for further delay.

·1 year agoIf the seller is found by eBay to be covered under Seller Protection, the refund will be funded by eBay.
If the seller is not thus covered, eBay initially provide the refund but will be reimbursed by the seller. The seller don’t have any choice in those circumstances, as the eBay User Agreement grants eBay permission to access the seller’s funds when a refund is owed.
I have the same concern as gutterpunkz has expressed, mind you.
id43564
OP1 year agoDear Contessa (I've always wanted to be able to write that!),
Not sure if I should be concerned, but if the seller appeals:
A) Do I have to wait for the result of that appeal before getting a refund.
B) If he wins, and he has had the item returned, does that mean I may lose my money and not have the item and be forced to be pay the return postage which chat said would be at his cost? Not sure I can rely on anything I have been told. Ebay keep moving the goal posts
I get the feeling I am being run here; he knows all the tricks and I could end up with nothing.....guarantee or no guarantee.
countessalmirena
·1 year agoYour refund should be issued irrespective of an appeal. I do have to say should. But generally speaking, if eBay later find merit in the seller’s appeal, they (eBay) would wear the cost of the refund.
In light of the seller’s clear pattern of bad behaviour, the seller would be doing a Sisyphus to induce eBay to find in their favour on the strict grounds of not having sent the item until past the EDD.
My main concern would be the type of dispute - but as this was chosen by the CS rep, and you have a copy of the chat, hopefully you’ll not be out of pocket.
id43564
OP1 year agoDoes anyone know, sho pays for the refund under the Ebay guarantee, Ebay or do they get it back from seller?
'Cos it seems that Ebay are doing everything they can to arrange things so that the seller has to provide the refund rather than it being done under the guarantee.

gutterpunkz05
·1 year agoEbay can elect to make a goodwill payment to you, in which case it is solely funded by ebay. Or they can hold the seller accountable, given the nature of your INAD claim, I think the seller would have a very high chance of winning an appeal.
id43564
OP1 year agoEbay chose the INAD case type and created the case whilst I was on chat. They stated that it was the listing not as described not the actual item not as described, due to the delivery date on the listing not being kept to, which it couldn't have been as he never initially sent it.

OP1 year ago"He had 2 days to send them, so didn’t keep his end of the bargain, technically Not As Described".
As he marked it as sent untracked shortly after the order was made (possibly within 2 days) could he not argue that he did send it then and that it got 'lost' in the post and that is why he sent a 'replacement' (even though he was asked for a refund).
If he can successfully argue that he did send it untracked (without being able to prove it) he could theoretically make significant deductions for the return. Ebay has promised I will get a full refund with no deductions and that he will be liable for the cost of return if he wants it back . But their promises, even in writing, don't seem to be all that reliable in the face of someone who is running rings around their system.
So does claiming to have sent it international untracked (especially where the listing did not state that was the method AND I objected to that method straight away, by messaging him at the time), give him a way to excuse himself for not having sent it until after the due date?
Is untracked ever an available excuse/proof of posting acceptable to Ebay on appeal by a seller?

OP1 year agoI have been an Ebay account holder one way or another and almost entirely as a buyer since the 1990's, from right back when they started.
Maybe I have just been lucky up until now, but I can honestly say that I have NEVER come across such a totally atrocious seller such as this guy and in pretty much every way possible.
Whilst these days I am careful to look at negative feedbacks before ordering, I have to say that getting issues sorted out even with sellers in China has been a total delight compared to this guy.
Ebay keep telling me that his account is going to be looked at carefully and action taken but that doesn't help me and I suspect that is just the script talking. When a seller has sold tens of thousands of items, Ebay know where the money is and that can only mean keeping the sellers happy regardless of obvious bad behaviour. Has any seller ever been removed I wonder and if so, don't they just pop up again under a different username with a different email address.
After 30 years, I am never going through this again and I will try in future not to use Ebay if I possible.
Losing buyers is clearly of no concern to Ebay.

OP1 year agoSeller had 3 business days to provide either the return label or the cost of the return postage.
On the first day he said he would provide a return label which was never sent.
30 minutes before the deadline expired at midnight last night, he sent a message (his first) asking for my email address.
I asked the chat agent this morning for my refund and he told me that because the seller had sent a message last night, 30 minutes before the deadline expired, that Ebay will now extend the time the seller has to provide the label or the return postage cost by another 5 days until the 17th March.
Clearly the seller knows exactly how to cynically play the system and that can only be totally obvious to Ebay, yet they are allowing it.

OP1 year agoI think this comes down to two questions.
1. Does the seller have to abide by a claim for a refund for item not received and does sending the item void the claim for a refund or does it still stand?
2. Where there is a claim for a refund for item not received and the seller ignores making the refund and sends anyway (especially where they lied and never sent the item in the first place), can Ebay disregard their own item not received guarantee and extend the due date if the seller has sent the item after the claim for a refund for item not received by the original due date?
springyzone
·1 year ago1. I would think it comes down to what ebay rules on this and in your case, it seems as if ebay has given the seller extra time for the package to arrive.
In my opinion, if you opened a claim and there was no tracking number in the system at that time, you should have been given a refund, but obviously that seller has hightailed down to a post office, as you say, then got online to provide a tracking number in his reply. Very annoying.
But I am not ebay & ebay has given them an extension.
Had there been no tracking number provided at all, I think ebay would have awarded you the claim and the seller would have had no choice but to abide by that.
I suspect that your claim is still open, it has not been voided as such. If the seller's item is not there by the extnded date (14 March) then you should be able to finalise your claim. If it arrives before then, then yes, I think your claim is void in ebay's eyes.
2. It would seem so, wouldn't it! As someone said, so much on ebay is automated these days. I would think the system just took into account the tracking number without looking too closely at the exact time or date it was generated. In any case, the seller has been given an extension..
-------------
Whatever you do, do not just return the item to sender or refuse to pick up from PO.
You'll likely lose everything, money plus the items. It will be deemed your fault you didn't get them. Remember, the official date now is the 14th as far as ebay is concerned. Ebay isn't considering the earlier dates.
So take possession of those items, examine them carefully. Slightest deviation from the ad and you can open a different claim-for item not as described, faulty, whatever. You'd be likely to win that one!
id43564
OP1 year agoThanks for your reply which shows good sense.
Things have moved on since yesterday.
Now that the item has arrived and the original case closed, Ebay is insisting that because the original due date was missed, that the seller needs to provide a full refund plus the return postage in advance.
You are correct that the AI probably didn't take into account the original untracked issue or that the actual tracked posting happened after the claim was received by the seller.
Nevertheless the item had to arrive for it to be returned, hence the extended due date so that the claim was put on hold until then.
Judging by the reaction I got from the agent who explained all this and arranged for this to get sorted, the agent was furious with the seller and this matter is going to have repercussions for him having been reported to Trust and Security.
It's right that sellers like this don't keep getting away with gaming the system because it creates so much hassle for everyone. It's going to cost him a lot of money for postage both ways so hopefully he will never do this again to anyone else.
springyzone
·1 year agoWow, I must admit, I didn't see that coming.
I assumed that if the item arrived, ebay would be happy with that outcome and deem it as problem solved.
You are right, the seller will learn a lesson if he has to provide return postage and full refund.
What is baffling me is why any seller would do all this. If the seller was prepared to dash to a post office and send it once you opened a claim, then why not send it earlier, on time, and avoid the problem?
The only conclusion I can come to, and it's a bit of a worrying one, is that the seller is playing Russian roulette, in that maybe many buyers complain to him but don't know enough to actually open a claim in time, so the seller gets away with keeping the item plus the money. But if a buyer opens a claim, he immediately sends the item in the hope he can stay under the ebay radar?
It would be a risky game to play though.
id43564
OP1 year agoEither way Ebay are going to go back and review all his past transactions and reviews to see if there is a pattern.
If this sort of behaviour started to catch on because sellers found that they could get away with it, Ebay would become a no go zone for many buyers.
The total cost of the postage both ways which he has to pay, is about $180 AUD (about 90 Pounds) so it was a gamble which backfired badly for him.

·1 year agoI hope you receive a refund.
There is no way that eBay can force the seller to provide return postage.
Much of what you were told was to placate you & get you off the phone.
Is there a current case open?
id43564
OP1 year agoYes there is a return in progress under a bit of an odd case type: listing not as described due to the late arrival which differed from the due date on the original listing.
I have the chat with the agent, in writing, confirmed by a second agent, also in writing, of a promise for a full refund plus the return postage either as a payment from the seller or as a label, in advance, before returning. So I have full confidence that Ebay will abide by their written promises. What Ebay does with the seller to obtain those funds from him, is Ebay's concern, not mine.
id43564
OP1 year agoThe seller has accepted the return and said that he will provide a return label, but 24 hours since then, no label has been sent. If he fails to provide the label then I still get a full refund and he doesn't get the item back.

I'm screwed either way: If sent it back by refusal, it takes up to 3 months, is free of cost or I send it back at my cost and pay the postage outbound and return which will mean the total postage will probably come to more than original cost for the item and postage so in effect, no actual refund.
As for the guarantee.....Ebay have already voided it by extending the due date to 14th March because the seller sent it eventually, even though the claim was for a refund not a 'replacement'.

·1 year agoWait until you receive the item. It might be what you wanted or it might not. If not, open an item 'not as described' case.

·1 year agoSo you bought an item, it didn't arrive and you asked for a refund. Now it is on its way you intend to send it back when it arrives? Assuming you wanted it in the first place, why would you send it back? Seems a bit of "cutting off one's nose to spite one's face" action.

OP1 year agoNo it isn't. He lied, he didn't send the item when he said he had and sent it 3 weeks later after he was told to refund and not send it. I don't see why I should reward him by keeping my money when he lied and a month later I still dont have the item or the refund he was supposed to make.
Why should he endlessly be given extended due dates when he marked it as sent untracked but never sent it. You can reward liars if you want, I don't see why I should have to.

·1 year agoso, you've left them negative f/b......no, it's not fair....I hope that when you do receive them that you are delighted....but if they are not 'as described', then you have an 'out'.
I don't know what else to say, sorry.....

OP1 year agoThe fact remains that I was told yesterday by Ebay claims to call today for my refund if I didnt get the item by yesterday as per the Ebay item not received guarantee. The fact that the seller ignored the refund request in the claim is their problem that they then sent it. Ebay then surely can't extend the due date when the claim was for a refund not a replacement (though in this case it wasn't a replacement as he never sent it).
The issue is Ebay moving the goal posts/due date to suit themselves and then blocking me from talking to anyone who can do anything about it.

OP1 year agoThanks, I appreciate your supportive understanding. I just don't like liars gaming the Ebay system and then Ebay giving all the support to the slippery liar whilst ignoring their own guarantee.
