I recently purchased a $670 Lego off of a seller - needless to say I read the reviews too late, and I have been scammed.
PayPal has sided with the seller - as the tracking miraculously showed as delivered when I escalated this to PayPal.
How do I escalate this?
I have proof of what he sent was an express post envelope - was addressed to an occupant in my suburb and had a different name on it. the Lego box is approx 59cm long and 48cm wide. The seller does not respond to any messages etc.
I am so frustrated.

·1 year agoThe items were all sold multiple times and hopefully buyers have kept all the details they have.
Because now, the seller is no longer registered and the listings will no doubt be removed from this site.
There's a good chance buyers won't be able to open 'item not received' disputes in the usual way and obviously they're not the usual "item not received."
Many won't know they could go to Live Help and ask for it to be opened manually and even then they face a battle
Hopefully a few buyers will ask here.

I did wonder if ebay had restricted the seller or if they were facing multiple claims when I looked the other day as there were no items for sale, but at that time they had no unregistered.
I don't know if the seller de-registered himself or if ebay did it, but it should be a giant red flag to ebay if it isn't already.
In my opinion, buyers should be able to open claims about any item bought before a seller was unregistered, it is plain wrong if they can't. (Mind you, my opinions count for nought, I know, & ebay does its own thing).
But surely, chaz, if you get back onto live chat to a human, they should be able to see the problem and you should definitely be entitled to a refund. I think ebay's problem might be all the refunds have to come out of their own coffers because as far as I recall, that seller had had quite a bit of recent feedback and would not have been in the 30 day wait period. And we're talking sales worth hundreds of dollars at a time.
That's their problem though. You're obviously the victim of a scam, you should get your money back.
And nope, ebay isn't necessarily a safe place. Thousands of different sellers, some are sure to be dodgy.

eBay's closed the selling account. The seller couldn't have due to recent transactions.
Once the listings have been removed , they'll generally disappear from the Purchase History page.
Going to Live Help and asking them to open a dispute manually can be done but the problem is that they're all showing as 'delivered' due to tracking for an envelope sent to the same postcode.
eBay is fully aware of the scam evidenced by the buyer in the other thread who was eventually refunded after eBay closed the 'item not received' case in the seller's favour.
This is huge.
One listing alone sold 27 = approx $20,250 .00
I'd also encourage all buyers to keep their eyes and ears open on social media if they're not refunded.
Any mention of group police reports ...anything that can help.
I actually came across an adult lego collectors page on facebook, where someone had posted a picture of one of the listings about 6 weeks ago, asking others' advice on whether they thought it would be safe to buy.
No negs at the time.
The answer was:
The seller has 200 positive feedback.
If anything goes wrong, you'll be covered by eBay or Paypal.
Hopefully he didn't go ahead and buy.

OP1 year agoUPDATE:- have been on the phone with paypal twice today. Firat time the fellow said i was the 2nd person to report this seller, they just need an official letter from aus post and i will be refunded. I provided this at lunch time.
Then i get an email, my dispute has been refused again as seller provided delivery scan.
I rang them again and spoke to another fellow who couldnt understand what i was telling him. That the item is delivered 🤦♀️ finally he kinda of got it (35mins later) i sent through aus post letter and photo of express env addressed to the resident at a completely different add to my work place which incidentally is Australia post.
1 hour later - dispute is closed in favour of seller 😤 rang them again... this time i get told that the latest screenshots werent uploaded to my dispute.. she assures me this is now done. I asked her to please make sure the dispute team looked at all the screenshots i have uploaded (10 of them). So now i am waiting to hear 😔

·1 year agoNothing to lose at this stage I reckon - open an Item Not as Described case.
Because let's face it, that's a true statement.
Oh, and seller pays return postage, to boot.
Don't forget to send it with tracking and upload tracking to the case.

Honestly, this is plain incompetence. The whole point of the conversation was that the tracking details were false. They have had the same report about the seller from another buyer. You've got the aus post letter as evidence. What do they not understand?
Keep plugging away at it and let us know how you go. Good luck.
PS And if you ever buy anything on ebay in future, really check out the seller and feedback very carefully, double check, before you commit to buy. I personally avoid sellers based in China if I can and those with a string of bad feedback. You have to be extra wary on expensive purchases.

·1 year agoChaz, for some reason, in my experience, lego is a dicey item to buy on ebay. I don't know why, but in the past few years the only hassles I have had have been with lego sellers.
You can't name a seller on here but you can tell people the item number.
Let me just say this is a seller with a feedback rating of 93%, (yet listed as one of ebay's most reputable sellers) but if you look at the recent bad feedback, in each and every one of them-the last 10 sales this month-the story has been the same-fake tracking number.
I notice the seller no longer has anything up for sale.
In my opinion, you need to get onto ebay help, persist till you get to talk to a human, explain the scam and ask them to look at recent feedback for that seller. It should be obvious there is a problem with the seller, maybe a hijacked account, I am not sure.
But the seller needs to be closed down.
Hopefully that has happened and ebay are on to it, but you need to talk to ebay.
The people who bought low cost lego in the past seemed to have good service but all the high priced items like yours were scams so i think the seller has instant access to funds, no waiting period.
It is a shame you went through paypal first as I think you may not be able to open an ebay claim now.
It has to go ebay first, paypal next.
But talk to someone at ebay. This is a large scale scam, tell them you will be making a police report.
You may be able to make a bank chargeback, I don't know.
Others here may be able to help you better, I hope so. Good luck.
