Longines Watch purchased for $485 even wearing the first day it stop plus running 6 minutes slow every 24 hours I took the watch to a watchmaker and it was advertised as swiss movement not cheap Japanese movement The watch maker said the watch is a total fake even though it was advertised as genuine I message seller 4 times zero reply so contacted fair trading about this item and a mobile phone when the seller refunded me only half on a non working rubbish fake phone he told me to sell it Well I have morals and ethics where eBay wouldn't care if I resold these broken items on eBay Just waiting on fair trading as it illegal to sell
Faulty broken fake items if eBay don't step up to the mark fair trading will help me in small claims court Just need sellers address So it appears that many crooks are hiding behind there computor screen and not replying

·9 months agoYes, the small claims courts are not worth the effort. I went to the ACCC, and even they were a nightmare, I had to go to my sitting MP to get some action. When the federal government stepped in, I finally got a resolution.

You may still have time to get a full refund. From ebay.
I am like repentatleisure in that I cannot fathom why you are going about things in such a convoluted way.
I understand you have not had a lot of experience on ebay. However, when things went wrong with 2 purchases-where the items broke down or were faulty from the start-did it never occur to you to look at the ebay help pages to check if something could be done? Or what you could do about it.
If you had done the least bit of research (and it isn't hard to find) you would have see that if an item is faulty, you can open an ebay claim. You don't need the seller's permission, you don't even have to contact the seller. You are in control here.
But you need to open a claim within 30 days of receiving your item.
If you are still within those 30 days, open claims today. And follow through, don't allow the claims to lapse.
A seller who has such a claim opened against them has to provide postage costs for the item to be returned. If they won't, get ebay to step in.
If you do open a claim, I would suggest you claim for faulty, not working or not as described. Don't go saying fake as the seller will counter claim not fake and ebay hasn't seen the things, you might lose your claim.
Stick to plain and simple-faulty, not working properly.
You might go to fair trading but the first thing they will ask is why didn't you open an ebay claim?
You are right about one thing though-buying phones and expensive brand name items is risky on ebay unless you're buying from an authorised seller. If you want a genuine item with a guarantee, go to a real shop.
And buying from overseas sellers is risky too. Do your research. You found this board, you can find how to open a claim. Have a look at your purchases in 'My ebay".

·9 months agoAll of what you say is very good, except for one vital thing: eBay and all similar platforms don't make it very easy to get anything done. I can still remember me going through all of the hassles to resolve my first seller issue. It did finally get resolved in my favour, but ebay asked me to remove my negative feedback, not because of language issues, they thought I was being too hard on the seller!
Things need to get better.

The seller you left the neg for has utterly appalling feedback , utterly garbage ,but you bought anyway
Opening a dispute where the seller is unhelpful and/or clearly lying is all in the power of the buyer, so I am not sure what mean by all the hassles. The buyer opens a dispute and follows through with it, they do not need to go back and forth with the seller, playing games
And keep neg feedback within the rules
Putting you are going to cancel your eBay account in your feedback to a dodgy seller achieves exactly nothing

You are right, in that when things go wrong, it can be a learning curve to discover what to do next. But that is the same with anything in life.
I think a lot of people, when they make a small purchase that goes wrong, shrug their shoulders and don't bother to do anything. My daughter was like that once till I told her-it is not hard to open a claim for an item not as described or faulty. Even then, she was saying "it's only a few dollars."
Sometimes, if you want a resolution to a problem, you just need to make the effort.
There are at least 2 ways a buyer can get where they need to. If they go into the 'My ebay' section, there is a drop down menu next to each purchase. One of the tabs says 'I did not receive this item' and another says 'return this item'.
If buyers don't know about that spot, if they go to the Help tab, the first thing that comes up once they click (or it did for me) is Need help with a recent order? Then it shows the recent items and gives clear instructions on how to open a claim.
The help is there & it doesn't take too much effort to find it.

Did you check feedback before you purchased?
Did you leave the seller neg feedback?
eBay do not read here nor will they care about threats re fair trading or small claims court if the buyer has chosen not to use the tools they are given to resolve such issues
Is the seller even registered in Australia?

·9 months agoHas anyone read all of that? Did you notice that the writer is very new to eBay? How easy is it to get to where you say they should go? Things need to be made easier for buyers.

"Help" is hidden in plain sight on every eBay page.
The eBay Money Back Guarantee is also hidden in plain sight on listings.
Couldn't be any "easier" to find & use.
