    Hi, I purchased an item that is subject to a recall on electrical safety issues.

    Ebay emailed this to me.

    This product was purchased 10/09/2024 and would seem to be past any right to dispute and claim a refund.

    Since I was only made aware of this recall today, am I eligible for a refund?

    Any help appreciated.

    I got the exact same message so I mailed the product back to the seller. The seller wasn’t answering any of my questions so I asked Ebay to step in. I now have an email saying that the case is closed and I will not be getting a refund. I don’t have a refund for $126 And I don’t have the item either. I’ve been trying to contact Ebay but I’m not having any luck. I’ve tried every avenue through the computer generated BS. I’m requesting an agent but then I get a message saying “something went wrong”  I am **bleep** off to the max.

    That would be because you didn't open a relevant case.

    Hi rita8341.

    I got in touch with the seller of the Chinese product in Australia and they passed on my request to the Chinese seller.

    The Chinese seller got in touch with me and made a refund offer I could not refuse and told me to keep the product.
    Do not take any notice of Ebay's knockback, that's just step one.
    I suggest you phone Ebay and insist on a refund---the product has been recalled!!!
    Always be polite, but let them know that you will lodge a complaint with the Ombudsman.

    That's very bad advice. 

     

    It was the actions of the person you are replying to which excluded their transaction from coverage under the MBG. Their own poor choices led them to the result of no refund. They were not forced to make those choices, and did so if their own free will. This will always be the outcome when someone decides to stray from the correct procedure and just do their own thing.

     

    Telling people to contact eBay and pester them for a refund on an item that quite obviously isn't covered is extremely bad form. Likewise with the empty threat of involving the ombudsman.

     

    You should actually be advising people to NOT clog up the process with pointless, illegitimate complaints.

    Why would you give someone some mislead 'advice' ?

     

    You don't follow the MBG, you are not covered

     

    The Ombudsman is not going to do anything about dodgy sellers in China who sell stuff not fit for use in Australia, nor cover a buyer who chooses to buy a dangerous knock off from China in the first place and then complain it's dangeous

     

     

    It was dangerous when they buyer made the choice to buy it

     

    Before any recall

     

    Or if a recall never happened 

     

    I suggest people not buy dangerous knock off in the first place

     

    And to never buy electrical items from random dodgy sellers in China

    You do understand that we're in Australia, right? That link you put up is for UK (haven't looked at it - just recognise a UK URL when I see it)

    40 Celsius in December, yup I do understand.

    Ebay Australia, not the UK emailed me about the recall.
    If the item has an electrical fault, I want to know about it.

    eBay have said the product MAY have been recalled, and have said to you to contact the seller (good luck with that if you dealt with a Chinese seller........)

     

    They have also said to contact Paypal, so that is who you need to deal with.

     

    Be aware that Paypal now requires you to pay for the return postage if you have to send the item back to China.

     

    Is your item exactly the same as the one mentioned in the recall ?

    Hi padi, thanks for your reply.

    The item is the same model as the recalled one, Ebay put a stop on the seller's listing, and I am waiting for a reply from the seller.

    Although made in China the item was purchased and shipped by an Australian seller.

    Tomorrow I will phone PayPal and see what they have to say.

    Yes I have a Chinese seller however they are in Australia not in China. I received a message saying the product has been recalled and I have to return it to the seller.  They have my product which I returned and they have my money. I have nothing. I have appealed the case because Ebay told me I was not getting a refund.

    If they are located in Australia, how exactly do you know they are Chinese? Have you met them, or enquired about their lineage?

     

    If they are registered in China, there's a 99.9999999999999% chance they're in China. What makes you think they are in Australia?
