Ebay should just implement age verification and stop this ridiculous heavy handed policy that prevents legitimate users such as myself from purchasing legal items.

I can buy alcohol from ebay. And I can buy axes and knives in retails stores. There are no restrictions for me, so why is ebay restricting me.

·1 year agoFalse equivalence as ebay seller restrictions are not the issue being discussed. Besides, you do not need a license to sell knives or axes in any capacity; all of the restrictions are applied to purchasers under 18. But even if there was a 'blade licence' for sellers, the current restrictions would still not allow me to purchase.
The fact remains that it is entirely legal for me to purchase bladed tools in QLD and yet ebay will not allow it. But does allow it for other heavily restricted items, providing you can prove you meet those restrictions. Like alcohol.

·1 year agoThat is the restriction, over 18 you must be able to supply suitable age verification as declared via legislation.
Ebay does not have a method to comply with legislation and as such has enacted a blanket ban.
At least this item is actually on the restricted list.

·1 year agoBecause of what ID is deemed valid under the specific legislation. The specific legislation regarding knives etc has nothing to do with legislation regarding liquor/alcohol, and vice versa.
The sale of liquor is dependant on the individual seller holding a liquor licence, and the individual seller is legally responsible, for every sale meeting their licence conditions including age verification. Ebay holds no legal responsibility under the liquor act.
Under Qlds knife legislation ebay and each and every seller is held legally responsible, (no responsibility applies to the buyer), however ebay has no way of verifying that an individual seller is abiding by the legislation.
The legislation itself is also contrary to ebays Legal T&C's.
Due to the penalties that can be applied to ebay, for what is effectively beyond there control, In contrast to ebay terms, and given the fact that ebay can not legally be compelled to permit the sale of any particular item. Don't expect the blanket QLD ban on sales of restricted and controlled items, to change anytime soon.
In the mean time you could learn to understand the legislation, and lodge a formal complaint with your local MP, (you could also pen a letter of appreciation to Jacks parents, for trampling on your rights)

You need to sign for knives at the post office, i.e. provide ID. If it's a restricted item, the necessity to check age will show up for the postie.
Either way, zero laws about selling knives to QLD online, therefore the rule was ridiculous, therefore the rule has been removed as of sometime between this post and my comment.

If you read the entire thread, you will see that I am aware some listings are taking advantage of a loophole in the system, and I have purchased and had a number of items shipped to Queensland, just to prove it is possible.
However there has been no change to Qld legislation, and ebay has not advised of any change to the policy.

·1 year agoJust to add, yes you can buy axes and knives in B&M stores, and if you appear to be under 25, your age verification must be sighted and recorded.
Many B&M stores who also have an online site, will now sell restricted items online, but require that the item is picked up from there nearest outlet, so as to comply with the legislation.

·1 year agoThere is zero restriction. Any dangerous object has to be signed for or picked up from the LPO, so the postal service naturally applies restrictions on such purchases anyway. The Ebay rule has been appealed after I presume many buyers and sellers alike complained

·1 year agoYour point is what exactly? Trying to scold me for having a rant. "Blah blah there are restrictions here there and everywhere so you may as well just accept it". Some people are willing to fight for what they believe in. So YOU roll over and take it. This is part of a bigger movement that has already disempowered Australian people to become weak men like yourself.
Not that a knife is even a weapon. It's a tool. As is a pointy stick. It becomes a weapon when a person employs it to do that job. So you can outlaw knives and spears and toothpicks all you want but real people will never bend down to such rubbish and will hold the companies and leadership accountable.
There is a real issue here. We should be giving kids knives, and showing them how to use them. Teaching proper values, respect and discipline but we can't exactly because of bull**bleep** like this and the bull**bleep** safety warriors and those accept it.

·1 year agoIf you bothered to read this thread in its entirety, you would know that I do not agree with what is very poor legislation, and have been advising members from day one to complain to their local member, ranting on ebay and blaming ebay will achieve nothing.
You do not seem well informed on the subject, your pointy stick even meets the definition of a knife, but hey that means nothing to you. Have you bothered to read any of the legislation, did you make your objections known before any phases of jacks law were introduced, or have you just stumbled on it as an issue on ebay,
Are you aware that the majority of Qld retailers who still sell knives online, will no longer ship them and require them to be picked up from their nearest outlet.
When was the last time you bought an axe or any similar tool in a B&M store in Qld.
And by the way there is nothing stopping you from giving a knife to a person under 18

Have you noticed coles has removed all knives from sale, Australia Wide. Other companies are bound to follow suit.
Many Qld retailers, no longer carry knives, restricted or not. Vic has just passed laws to control the sale and use of machetes but as yet they don't have a definition of a machete, bet it will cover far more than most would consider a machete.
NSW & WA have already implemented parts of Jacks Law and will probably implement additional parts in the future.
By the way, a spear meets the Qld definition of a knife

Likewise I use credit cards to purchase, but still get blocked from buying knives etc, not surprising as paying with CC does not rate a mention in the Qld legislation, as a valid form of ID or age verification.

·1 year agoWell, now coles is pulling all knives from sale, Australia wide, due to another juvenile, now charged with attempted murder of a coles staff member.
As with ebay, coles is under no obligation, to sell or allow to be sold any product be it a knife or anything else.
How many other retailers will follow suit. ( plenty have already done so in Qld)

Note,: other jurisdictions have already or are considering bringing in parts of Jacks Law, so in time these restrictions are likely to include other states as well.

·1 year agoIt's just another bit of rubbish legislation foisted on the Queensland public by the last, far left state government. It's pathetic, I tried to buy a new electric knife to cut the Christmas turkey. Can't do it, I keep getting a QPS message saying you can't buy knives in Queensland. The legislation only applies to people under 18, and even though Ebay has all my details, there is no attempt to verify the age of the buyer. Ebay owes it to the the sellers and buyers using the site, to sort this out. I ended up buying it from amazon instead.

eBay does not 'owe' it to those who stamp their foot and demand anything/any item be allowed to be sent to their location . It is like those who want to demand eBay allow them to buy plants which are restricted to their state, or items from overseas that are not allowed through customs

Nobody has to buy anything (knives included) from eBay alone

·1 year agoRecently encountered this problem when bidding for an item, but the item in question is *not* a knife but a collectible chisel.
It’s really bizarre. I’ve confirmed with the seller that the item chisel is in the correct category (not a knife), so I’m unsure what to do now.

It definitely wasn't in the "knife" category, so it would appear that anything with an edge on it falls under the ban in Queensland.
Oh, and the seller is registered in Queensland....................

Got this from a Qld lawyers site. It refers to what may constitute a knife under the Qld weapons Act.
While it might be a simple and silly question, it’s a valid one that helps clarify the law. Under the Weapons Act 1990, a knife is anything sharpened or pointed object that can be used with one or both hands to potentially wound and threaten someone.
This definition means that even seemingly ordinary objects can be considered knives under the Act if they meet these criteria:

Note, only got this message for 1 of several exempt items that were denied.

·1 year agoI am trying to buy a bread slicer on eBay because I make my own bread, these don't have a knife included. The Queensland warning comes up and I not able to purchase the item. I have tried multiple sellers, and I get the same message. I have contacted the eBay robot, and it doesn't know what I am talking about. I have also contacted one of the sellers, they also don't know what I am talking about.

·1 year agoHas anyone found out a way to find if an item is restricted or not? We sell many training swords, knife sharpeners and they are restricted because of the wording. Ebay tells me there is no way for a seller to see if an item is restricted or not, it can only be done on checkout.

·1 year agoThank you for all the work you have put into this. I was shocked this afternoon when I tried to order some Swann Morton blades that I use for my hobby work, and a big red sign came up to say I was not allowed to purchase them because of the QLD Legislation.
Anyway, if things go as stormboy04 reports above, we may be able to order them in about a week's time. I can wait a week. Otherwise I suppose its a case of finding a local surgical supplies store or a hobby store than stocks them.

I'm also going to let one of the Ebay sellers I tried to purchase the scalpel blades from know that Queensland customers should be able to purchase from them in another week (fingers crossed).
