    Received Counterfeit Microphones - Interested to know other buyers experience with claims processes
                     

    Hi,

     

    I purchased 2 microphones from a seller. They were advertised as Being Shure Beta57a products.

    While waiting for the item to arrive I noticed the seller received feedback from another buyer stating the two microphones he/she received were counterfeit. Apparently both boxes contained the exact same serial number.

    When the microphones arrived I checked the serial numbers on each box to find that they were identical. There were other clear signs that the mics I received are counterfeit (spelling mistakes on packaging and missing key identifiers).

     

    I raised a return as item not as described, the seller accepted (I suspect this was automatic) and I did not hear anything further from the seller. Called eBay Cust Service and was advised of the process. Waited the mandatory 3 days before raising a case. Waited a further 5 days without any communication before calling eBay customer service to check the status. eBay customer service advised that the previous agent made a note in the system that I was unwilling to return the items (I raised a returns claim....) and that I now needed to wait a further 5 days to see if the seller issues a return postage label. Questioning eBay customer service about why nothing had been done to date was fruitless as have been the requests to speak to a manager/supervisor.

     

    Curious to know if this the norm and if anyone else has had a similar experience. Feel like I want to push for a resolution and refund..

    Shure  are aware of counterfeit items being sold worldwide, 

    Note: Customers often provide photos of suspected Shure products and ask Shure to ascertain that the products are counterfeit based only a serial number or on photos. In certain instances, the photos have enough clues that Shure can determine that the product is counterfeit. But this is not always the case. This is no different than counterfeit currency that must be examined by government experts. At times, photos, no matter how detailed, do not provide enough proof.

    Also, photos alone, no matter how detailed, cannot provide enough proof that a product is genuine Shure.

    At the moment the case was put on hold by eBay. To give the seller a further 5 days to respond to the return request. The return was accepted the day I raised it. The seller has already had 8 days to send a label/refund but hasn't done so. Does eBay have a history of dragging these things out by just adding extra days for the seller to respond?

    Did you actually communicate that you were not willing to return the microphones? If so, why? (Seller is responsible for return postage payment, being required to provide return postage label which you would print out.)

    No. I didn't state that I was unwilling to return the microphones. I did say that I thought it was wrong that counterfeit items should be returned to the seller so they could be resold. I did ask what the process was for counterfeit items and was advised that I had to destroy them in front of local police. I then stated that even thought I thought it was a bad policy I was happy to return the items.

    without the items being certified counterfeit by shure, then yes return them as required. Wondering if they may have been factory seconds due to production/labelling error.

    muz35, you should immediately make a stat dec about why you can see these are knock-offs/counterfeits, and/or get them examined by local Shure authorised distributor to provide statement on letterhead. You need to submit these to eBay in the case (and then contact Live Help to make sure it’s not missed), as otherwise you may have trouble. A claim based on item being a fake is not just a case of the buyer saying “It’s fake!”. Also, make certain beyond any doubt that eBay know you are happy to return and would like the postage label. eBay may tell a buyer they don’t need to return the item and should destroy the fake, but it’s somewhat unlikely that a buyer without supporting documentation, initially seeming not to want to return the item, will definitely win a case. Act quickly before the case is closed, just to get all of your ducks in a row.
