·1 year ago@popeye4444, sandypebbles has told you that the only thing you needed to do was to open a dispute. That is the bottom line.
If the seller asks you for this, that, the other, blah blah blah, that is a well-known tactic of luring you along and stalling in order to spin out the time and prevent you from opening a dispute, or from asking eBay to step in if the dispute is not resolved within the timeframe.
eBay’s dispute process is bot-driven, and there is no leeway; the timeframe for acting is set in stone. Read the Money Back Guarantee page thoroughly. https://www.ebay.com.au/help/policies/ebay-money-back-guarantee-policy/ebay-money-back-guarantee-policy?id=4210#section3
You should have opened an official dispute, asked for full refund, been given return postage label for faulty item, used that return postage label to send back the item, and then been given full refund by the seller.
If the seller didn’t agree to full refund or didn’t provide you with the return postage label, or didn’t refund after tracking showed “delivered” status, you should have clicked onto the “ask eBay to step in” button which appears within the dispute at the appropriate timeframe. eBay then take action (automatically, in a bot-driven response) and you’d have been refunded in spite of the seller’s failure to resolve the problem.
Is your seller registered in China? Unfortunately this is not atypical of some bad Chinese eBay sellers. Post the item number here (not seller username - only the item number from the listing) … or check the seller’s feedback page and click onto the “about” tab to see seller’s country of registration. It’s always worth knowing where your seller is registered, as opposed to the (editable) item location field in the listing.
As you say the seller dangled you like a marionette beyond the 30-day timeframe for opening a dispute (or beyond the timeframe for escalating if you did open a dispute), your only recourse would be a chargeback by your card issuer/bank, explaining to your bank that the seller delayed you by pointless and endless questions beyond the MBG period. As long as you funded your purchase by card (even if it went via PayPal), you should be covered for a received item not as described.

·1 year agoYes, as everyone here has said, you were strung along. (I could only see one reply when I posted!)
Contact your bank now.

·1 year agoWhy were you spamming the seller with 30 messages instead of doing the only thing you needed to do?
You needed to open and follow through with an item not as described dispute
You say it has been over a month, so you are out of time with eBay now
You aren't going to hear back, the seller strung you along until it is too late to do anything
You had the choice not to go along with it
What was the item number?
What was their feedback like as a seller?
Where are they registered?

OP1 year agoI was not spamming them They were asking Questions about the product which I answer around 30 messages which I replied to this seller seams to keep stalling every time I rspond with answer they come up with another question (30+)

·1 year agoThey ARE (successfully it would seem) stalling until your run out of time for a claim through eBay.
You will be unlikely to get any further questions as your window has closed.

·1 year agoAll you had to do was open an item not as described dispute through eBay's Money Back Guarantee within 30 days of receiving it and the seller would have had to supply you with a return tracked label within 3 days.
If not, you could have asked eBay to step in and you would have been refunded.
You let the seller play you.
Too late now for eBay if it's past the 30 days but you could try a chargeback with your bank.
