Seller did not disclose defect on electrical item and won't accept return

Summary: rockerob opened a discussion about an issue with a seller who did not disclose a defect on an electrical item, and the seller is refusing to accept a return. imastawka and sandypebbles were involved in the conversation, with imastawka participating frequently. Additionally, springyzone and *casey* joined the discussion later. The thread includes a series of back-and-forth responses, but the main point revolves around the seller's lack of responsibility and the difficulties faced in getting the item returned.

1.jpg2.jpg3.jpgHi, i just brought a Datavideo TLM-170 from Australian seller,

    https://www.ebay.com/itm/116336324808

    Seller advertised as
Datavideo TLM-170V 17.3" ScopeView Production Monitor'
Was NOT a ScopeView, older model
Seller added link for specs - wrong model
    https://www.avlfx.com/category/product/4618-datavideo-tlm-170v-17-3-scopeview-production-monitor-desktop-style/category_pathway-240'
Lead me to believe it was better model
I was going to let it slide as i was happy to buy a 17" monitor with SDI input for my video rack.

During testing i found the SDI input to be defective, SDI NOT working properly-bad image

Seller won't accept return, i can't start a return claim and i can't contact a real person on ebay to explain in plain english that iv'e been defrauded, while the assistant has me in a endless loop and spruking the 'eBay Money Back Guarantee.
Loosing money on a tool i can't use just sent me backwards and making me sick, not much faith in buying through ebay again.
Australian consumer protection? need some links to shout too please
Me 1700+ feedback, what do i know....

I wasn't sure what you meant exactly by start a return.

It may be that the seller does not accept returns (that policy cannot apply to defective items though).

Are you able to open a claim in ebay for item not as described? Faulty item?

That is not a return claim as such, it is a claim for a refund, although in the process, if the seller wants the item back, they have to provide a postage label. You're lucky this is an Australian purchase as the return should be straight forward.

The claim needs to be opened within 30 days of the delivery. If that has passed, you're out of time but if you paid via paypal, you could claim that way.

    Sorry my terminology,

No i wasn't able to submit a claim on the MGB page at all, the submit button being greyed out after spending 30 mins typing the issue in under 200 words or so,  it's been frustrating.

But a eBay rep is onto it now.

'You're lucky this is an Australian purchase as the return should be straight forward.'

Yes, i think that's why i am seeing action and help with ebay in this, we do have some 'lip-service' consumer protection laws in Oz.
I paid with afterpay, not sure if that has any policy about returns.
Thanks for your help,  all submitted now and in process

You need to open an item not as described dispute

No returns only applies to change of mind

If what you bought is not what you were sent, the seller does not get a say

Not sure why you mention your feedback, that has zero to do with the eBay MBG

Thanks Sandy, i meant i have been around the block a few times and i describe and disclose flaws with my sale items, but moreover, the issue was the claim button being blanked out, i had not come across that before.

"the issue was the claim button being blanked out"

Because eBay's removed the listing ?

It's showing in completed listings but when you click on the actual listing, it says the page is missing

You obviously didn't read the link I gave you.

You should be opening a case for Item Not As Described - not a return.

Stop communicating with the seller.  Open the case and follow through.

Do not let it lapse.  The seller has 3 days to supply you with a postage label if they want the item back.

If they don't, then ask ebay to step in and help as soon as the case allows.

Do not close the case no matter what the seller says, until you have your refund in full.

    You can't re-open a case.

    Please read the link.

Yes mate, i did go through your link,
Same link as i had followed previously through eBay and came up against the claim process blocked with the "Confirm Claim' button greyed out.
Probably because seller specified no returns in listing.
Refur image in my 2nd post

Had tried 'item not as described' and also 'defective item' in options.

Also, had not contacted seller at all.

Good news is a eBay rep contacted me this morning and started the claim for me, so the seller has 3 business days to respond to a defective item claim as of today.
    Thanks eBay rep monitoring posts.

Pretty sure you responders haven't come across a 'confirm return' button being blanked out before and the issue fully, might just be an Australian restriction you don't see in the land of the free.
    But thanks for responses anywho

As before, no returns only refers to change of mind on the buyer's part

    Nothing else

You are very very lucky someone from eBay read your post

    It rarely happens

Not sure what you mean by your last comment

This is the member to member forum for eBay Australia and responders here are in Australia who use the eBay Australia site. Not sure why you would think we are in the US

No, I have not come across anything like this for an item not as described dispute being opened

Return request is a different thing and different story
