If you have and they've refused, go eBay Help at the top of the page and when you get toi the automated assistant, ask to speak to a supervisor. Ask the supervisor to look at the seller's feedback.
If you paid with Paypal, you have 180 days from payment date to file an item not received claim.

If it's within 30 days of the last estimated delivery date , have you tried to file an item not received claim through eBay's Money Back Guarantee ?

Or you could try a chargeback through your bank.

To add, there are ways to appeal that decision if you've been the victim of a fake tracking scam but it's not that easy.
