    Seller is refusing to refund full amount paid

    The Seller is refusing to refund the full amount paid as he claims the shipment

    was not returned in the original condition..

    This Shipment was sent back in the SAME condition it was received IF it was

    damaged in Transit by AUSTRALIA POST  why am I being held responsible and

    being made to lose half of  my money?

    Was it a  "change of mind"  return or a  "not as described"  return ?

    The item concerned was advertised as GENUINE on receipt of goods it was not 

    hence the “return “ and request for a refund which I was advised by eBay  was 1/2 

    the amount paid apparently the “SELLER “ is deducting  1/2 the amount because the shipment 

    was received in “ damaged “ condition I have told eBay  surely this is down to 

    the AUSTRALIA POST HANDLING it is not my responsibility.. since then no further 

    correspondence.. should I contact eBay again as it looks like they have washed their hands 

    of this complaint.

    It is the responsibility of the sender, which is you in this case, to ensure items are packaged in accordance with AP standards.

     

    If it was damaged in transit by AP, de facto it wasn't adequately packaged.

    For any item returned damaged, the seller is permitted to deduct up to 50% of the purchase price to compensate their loss.

     

    FYI... almost all items which are damaged by Australia Post are deemed by them to be inadequately packaged, in which case the seller may deduct up to 50% of the purchase price from the refund.

     

    Just as the seller is responsible for any damage in transit on its way to you, you are responsible for any damage in transit on its way back.

    So out of curiosity,  did you open an "item not as described"  case through eBay's Money Back Guarantee ?

     

    It sounds as if you did but just checking.

     

    Or did you just ask to return the item ?

    Do you have proof the item is counterfeit ?

     

    Is it mentioned  in  your messages or in  the 'item not as described' case , if you opened one ?

     

    Counterfeit items are on the  Australia Post prohibited list.

     

    Has the seller given you any proof of damage ?

    Have you actually opened - a not as described case - if not do so if you are within the 30 limit - immediately.

     

    The seller cannot prove it did not arrive back in the same condition it was received by the buyer.
