"Counterfeit" item removed, which isnt counterfeit. What to do?

Summary: marks.market expressed frustration over eBay removing their listing of an anti-snoring product, which they assert is genuine, citing differing advice from eBay support. They considered relisting without using the brand name and checking differences in other listings. e_purchasing suggested it could be a trademark issue while brickworksmarket mentioned it might be an automated removal due to a word used in the listing. li-456325 advised against relisting without resolving the issue and suggested going through an appeal with proof.

    Hello everyone,

I have a product I am trying to sell. It is a popular product with a brand name, not generic. In Australia there are 1100+ listings for this search, with listings having over 1000 sales and existing on the site for what looks like years.

I have the invoice I used to purchase the item, and the brand has many products in their range.

eBay removed it instantly for being counterfeit. No email, no message, no backing to their claim. I contacted eBay chat and have had different responses:
One said I can submit the invoice and it will be OK to relist. Did this, it was removed again
Another said just relist it, but I havent tried yet. I dont want account restrictions

Third couldnt tell me, just kept saying it must be counterfeit.

Phone help just beat around the bush saying I have to remember that this is for the protection of the eBay community, and other similar bs.

This item isnt counterfeit. How can I get it through eBays thick as bricks skull? 23 years of selling, and I am just about over it.

This will be case ebay's automatic detection system flagging a word written and determining your selling a counterfeit item and no matter how much you protest to ebay they will say that your to blame and you cant relist it, the same goes for selling chance items such as mystery boxes & the Hanger Boxes that give you a chance of something rare, despite your listings getting flagged and taken down if you report the chinese sellers selling counterfeit pokemon cards, counterfeit games ebay says the listings are abiding by ebay regulations even if the listings say the item is Non Genuine chinese made, same for the thousands selling mystery boxes & hanger boxes, ebay will say nothing wrong with those listings even though yours were taken down.

First, check whether the removal was caused by an automated system or a Verified Rights Owner complaint from the brand owner. If it is a system flag, submit your invoice and clear photos of the item through eBay's official appeal process. If it is a Verified Rights Owner complaint, directly contact the brand owner with your proof and ask them to withdraw the claim, as that is often the quickest solution. Do not relist the item without resolving the issue, or you risk permanent account restrictions. If your appeal fails, weigh the time and effort involved and consider selling elsewhere rather than letting one item drain all your energy. Good luck.

Hi Mark, I m no expert on DVDS, but if you are referring to WM27, then I do not believe the image associated with your listing, is of an item compliant for sale or advertisement in Australia.

    Happy to be corrected.

No worries, just that wm27 search lines, met everything you described, qty listings etc.

So what was the item in question, or why can't it be mentioned on public forums.

Vero violations have always included an email and who to contact by the company who placed it.

As you say it was instant my guess it was something in your title that is causing the issue with ebay as it sounds like it is automated. Vero takes time for someone to find the listing to report it.

You will need to work out what word is triggering the response and go from there. If you can share the brand name maybe someone can help or try using AI and see if they can find a reason.

This would not be eBay, It would be a vero agent lodging a takedown claim on behalf of the manufacturer. They would cross reference if you are an authorised online distributor if it is a new item and request removal if you were not. If you listed it as used or removed the brand name , it would not get taken down

Its not an item that can be sold 2nd hand. Product is direct from the factory. It is for an anti snoring tape

Are you authorised to sell such a product?

eBay would likely see it as being a 'medical device'

Yeah I thought that may be the case, but I have authorization to sell medical and adult products. When I find the time to list it again ill use an alternative category

    The other listings, are they

The actual brand name, or 'for' ?

Are the sellers registered in China?

Is the brand part of VeRO ?

eBay staff are barely trained in anything, let alone what is genuine or counterfeit, and they all 'read' from the same pre-written scripts

The brand has a few products listed in the USA, none in Australia. One of the reasons I chose this company was for this reason. Its not a VERO issue.

Are the 1100 listings in a different category? What’s different about them?

Not a lot different really. Some are for similar items, not the exact item which is just how search works by nature. Seems a few are not listing the brand, just saying unbranded. So perhaps I will try this
