In Victoria: It is illegal to sell or use or advertise fruit tree netting over 5mm x 5mm aperture. It is deadly to our wildlife and today we removed two lactating Grey-headed flying foxes from netting. Their bubs back at the camp will starve as the bats cannot be released until their lacertaion and strangulation injuries from the netting heal.
It is irresponsible of Ebay to continue to allow illegal and dangerous products to be sold via its platform.

And what is allegedly illegal in Victoria could well be legal in the rest of Australia. Or the world.
Was the netting on your property, or did you trespass? Why did you not report the 'illegal' netting to the relevant authorities?

OP9 months agoThanks Dave, Yes we understand but they still need to comply with state law - in every country.
And yes they can legally (no ethically) advertise, sell, and ship wildlife deadly netting w a mesh size over 5mm x 5mm to addresses outside of Victoria but not in Victoria.
Re: Trespass : We worked w householders but in the event an animal is trapped and householders are away on holidays we usuallly notify police and enter to do the rescue. In over 30 years have not had a complaint yet. We leave a note as nets are usually cut to extract the animal - in one recently 25 rainbow lorikeets were strangled to death from a tree a half rotten apricots. We managed to release another 15. Remember calls usually come via a rescue service that the householders themselves call.
Re: Report : Yes. We do report. But w an entanglement life and death can be minutes not days or weeks away. We can't wait. But again - you bet. We report. We also try to educate rather than punish. Most problems particularly from people NESB: Non-english speaking backgrounds is not knowing the law.

·8 months agoYou say you refer matters to DEECA who are the authorised officers to enter properties. Are you a DEECA officer ? Your statements suggest you are not. You also claim if people are on holidays you enter their properties. How do you know they are on holidays ? Do they have a sign on the gate ? Do they phone you before they leave and give you permission to enter their properties while they are away ?
I,m sorry, but I,m not really following you. Why does eBay " still need to comply with state law ", but you dont ? I get that you are passionate about your cause, but dont the states laws apply to you, just as much as eBay ?
It seems you should be phoning DEECA and leave it up to the experts who are the appropriate authorised officers to handle the issue, rather than well meaning amateurs breaking the law and trespassing. The DEECA officers can also decide if education or prosecution are appropriate, including finding out were the nets were obtained from.

OP9 months agoYes thanks. We are working to alert both platforms as to the ongoing problem of selling these wildlife deadly and illegal-in-Victoria nets. It takes some doing as you can imagine. But slowly getting there.

Have you also reported the listings to eBay?
ebay don’t care, the individuals who buy it to kill birds and wildlife with don’t care, and the ‘people’ who sell it sure as h don’t care
Have you asked your local police station for advice, not that they will contact eBay obviously, but it better than doing nothing as far as the actual listings go

My intention is to alert both buyers to the problem and the platforms (Ebay and Amazon) that their facilitating the sale of illegal in Victoria and deadly (everywhere) products. And yes the issue is being investigated - again. I am a long time rescuers and advocate for wildlife.
Police (although authorised officers under POCTA 1986) will always refers wildlife issues to DEECA and if not wildlife to the RSPCA. But yes a crimestoppers report is always worth doing when illegal netting is spotted - it will end up at DEECA and they will notify the household of fines etc. Illegal netting is any netting w holes / mesh size over 5mm x 5mm - if you can fit a little finger through the holes it is illegal in Victoria (unless on a large commercial orchard - rare these days.)
