    Is it lawful for ebay to just TAKE MONEY from your bank account due to postage mistakes they made?

    I have just started up again on ebay and have not sold anything yet, but it sounds a bit scary that they do that. I know that we all agreed to the T & C but did we have a choice to say no and still sell ? 

    I am sorry you got all the responses with negative tones. I find a lot of people these days are just not nice when responding online.  I didn't like uploading my driver's lic  as they have a lot of our information.     Sorry if you believe that people stating what the policies are are ‘not nice’.

     

    Given the OP claimed it was done ‘without their permission’ when they absolutely gave permission, and had been advised in writing by eBay it was going to happen was not ‘nice’ either.

     

    If you wish to sell, you have to sign up for Managed Payments, there is no other option for an eBay seller.

     

    You are most welcome to say no, and not sell. I would far rather be given factual information than have someone be ‘nice’ and then find out I had been given false advice

     

    That is what eBay scripted responses are for, not factual but ‘nice’

    @vintage61sandy, you will need to upload a photo or scan of your DL or passport if you wish to sell on eBay. It’s a legal requirement even though it IS a small risk.

     

    However, we have the same risk when saving a credit card number on any site, on having MyGov ID, on having a bank account, or using anything where 100 points of ID are required. Literally all we can do is to minimise the risk by assessing the source of the request, the reasonableness or requirement for the request, and making our own judgement about whether the information will be secure.

     

    If you want to be disbursed funds for sales on eBay, DL will need to be shown electronically to eBay; that’s the long and the short of it.

    Thank you all for your input. I've learned a LOT from your responses, mostly not to attempt to ask a question again.  Apologies also if I have not posted or responded in the correct way, or "spammed" whatever that means.  This was my very first post and I obviously did not know how it was done, but thumbs up for making me feel great about my technological shortcomings.     Nobody said that you shouldn't ask questions, as doing so assists in the learning process... although I would suggest that it's probably better if you refrain from asking questions until you are prepared to receive appropriate responses. Nobody mentioned or even implied anything such as "technological shortcomings", so I have no idea what you're referring to... I'm guessing it's off somewhere with the insults that can't be seen.     Why are you spamming your own thread with multiple identical and somewhat irrelevant comments in response to the answers you've received?

     

    Unfortunately, I don't see any of these so called insults. If you can see something that nobody else is privy to, how about sharing it with us? It's hard to address your issue without all of the details.

    Well that's an interesting batch of replies... why do the responses to questions most often result in insults and stating the obvious.

     

    Posting this query was meant to enquire as to whether anyone felt they had been treated unfairly by ebay which seems to have been the wrong thing to do as a barrage of insults is not helpful.  

     

    Maybe ebay isn't the right selling platform. I haven't sold on etsy for many years until this year and I have found myself less than  impressed with the deterioration in their treatment or concern for sellers. 

     

    Which is exactly why I will not be selling, or buying from ebay anymore.

    You 100% gave them permission, you could not have sold anything with ticking you had read and agreed to the policies

     

    You would have also received communication from eBay that this was happening, as everyone who was effected did

     

    So why do you feel you ought to be excluded ?

     

    If you feel 'violated' and really do genuinely believe money was taken from your 'private'' bank account (for which you provided eBay the information and permissions for) then tell your bank that you actually didn't really do so and close your eBay account

    I did say that my post probably sounds harsh, but your use of the term "completely violated" conjures up a different reaction to, say, "completely outraged" or "very angry".

     

    The last time I felt completely violated was my first prostate examination 👆. It still haunts me ... I have to go take a shower, back in ten minutes.

    It has happened to a lot of people. When you listed the item, you agreed to eBay taking amounts owed as set out below... but then, you already know that this is part of what you agreed to and it is actually giving them permission. You don't get to change your mind and revoke said permission, and you most definitely shouldn't feel violated.

     

    So here's something you should take out of this scenario... it's a great idea to actually read what you're agreeing to before confirming that you've done so... that way you won't get any personally authorised "surprises".

     

    10. Collection of Fees and Other Amounts You Owe

    You authorize us to collect from you any amounts you owe us, our Affiliates (in particular the Affiliate which provides the eBay Services to you), or third parties who, as separately authorized by you, provide services to you in connection with your use of the eBay Services (such as shipping carriers), under these Payments Terms of Use, the User Agreement, any other service contract, policy, agreement or as required by law (referred to as “Owed Amounts”). Owed Amounts typically include the following:

    • Fees;
    • Amounts as described in “Returns and Cancellations; Refunds”, “Disputes” or “Fines, Penalties and Losses” in Section 7 above;
    • Amounts you owe the eMBG Service Provider under the applicable eMBG Policy;
    • Taxes or other charges related to your use of our or our Affiliates’ services, if applicable and required by law; and
    • Amounts we incorrectly settled to you due to a payment processing error or otherwise (see Section 1 above).

    For clarity, your authorization permits us to collect amounts which you already owe to us, our Affiliates or third parties as described above. This authorization does not establish any new claims for payment against you. In some cases, our Affiliates may assign a claim against you for payment of Owed Amounts payable by you to us.

    Collection of the Owed Amounts may be carried out on a one-time, sporadic, or recurring basis by the following means:

    • Retaining such amounts from your current or future disbursements relating to any transactions that you may have in connection with any eBay account owned by you;
    • Recouping from your Linked Financial Account (and if required, by issuing a direct debit mandate or other similar authorization);
    • Recouping from any other payment instrument or payment method you may have authorized or placed on file with us or our Affiliates (for example, to pay for seller fees, shipping labels, or dispute resolution);
    • Recouping from your stored value account, if a stored value account has been issued to you;
    • Recouping from your payment account, if a payment account has been issued to you; and
    • Retaining collections agencies or using other collections methods, if the collection by other means has been unsuccessful.

    You authorize us to choose the method of collection among those listed above. We generally deduct Owed Amounts from your current or future disbursements we process on your behalf. If a stored value account or payment account has been issued to you, we will deduct the Owed Amounts from funds held in the relevant stored value account or payment account before disbursing the funds to you. If your disbursements awaiting payout or funds held are not sufficient to cover these amounts, we will charge your Linked Financial Account or another payment method on file. If you have several payment instruments on file, you may indicate a specific payment instrument as your preferred payment method for collecting Owed Amounts in your eBay account.

    You also authorize the Affiliate whom you have entered into the User Agreement with for the provision of eBay Services to charge you for any Owed Amounts on our behalf from any payment method you may have on file with such Affiliate.

    If you provide us with a SEPA/BACS direct debit mandate for debiting Owed Amounts from your bank account, any required advance notice will be given to you at least three days prior to charging your bank account. At any point prior to you explicitly cancelling a SEPA/BACS direct debit mandate we have obtained from you, we may deduct Owed Amounts based on such mandate. Unless you are a consumer in the EU or UK, you waive, to the extent possible under applicable law, any rights you may have to receive advance notice of any particular preauthorized charge.

    If our attempt to recoup an Owed Amount from a payment instrument you have authorized us to use fails as a result of your acts or omissions, we may charge you for the failed attempt as set forth on the Fee Page or as applicable in Parts IV and V below.

    No insults posted. All replies provide factual information. No 'barrage of insults'. Feelings and personal opinions do not change the policies that all sellers have to agree to in order to be able to sell. You questioned if it was lawful and claimed it was done without your permission. Your choice if you use eBay or not. But as a seller, you agree to the rules of selling, and the policies really do indeed apply to every seller. Responses that tell it like it is without sugar coating are not insults, nobody attacked you or called you names, and you were advised if you genuinely felt the charges were in fact, not authorised by you, that you notify your bank (which is just common sense when someone states money was taken without permission

    Yes, it’s lawful. You agreed to this as part of eBay’s T&Cs for selling.

    I suggest you use MyPost Business for your labels rather than buying them through eBay. It’s cheaper (savings according to tier), direct payment to AP, no chance of eBay miscalculation or charging you for labels months down the track, it has eBay integration, you can still print your labels…
