·1 year agoHi again, just to add, I have had a quick look at your listings, have not got time now to check where the pics have been lifted from. However you are leaving yourself wide open to disputes, by stating (the clothes look exactly like the pic). Unless devices are calibrated, you have no idea that the image you have uploaded is identical to what is being viewed by a potential buyer

·1 year agoHi there, has ebay called your selling into question, or are you just dotting the I's in advance.
International contracts between sellers and suppliers are valid, if done correctly, but just a signed note is unlikely to hold up.

·1 year agoThe use of such a clause in the dropshipping policy is to provide eBay with legal defence in the event of data misuse. In my view, eBay fully realise it’s unenforceable between seller and supplier in the vast majority of cases, but it’s the seller who will be liable in the first instance if a Chinese supplier (for instance) used by the seller is demonstrably responsible for data misuse where a buyer is prepared to take legal action.
OP, do not take what I’ve posted as legal advice. It is not that, and I don’t represent it as such. Go to a solicitor / accountant specialising in this arena.
My opinion: dropshipping is fraught with difficulties. I would not buy anything dropshipped. Do this at your own risk.

Sorry, but members here are only going to give you factual replies
If you do not do things the right way, the eBay bots will shut you down from selling at all
And you will not be able to sell again on this, or any other account if that happens

·1 year agoseek professional advice, backed by professional qualifications, on all implications of dropshipping, including tax advice . . . don't seek advice on eBay discussion forums, where nobody will guarantee the information they provide.
Me, I'm just a 60-something retired teacher sitting on his lounge in his undies because it is so hot these last couple of days. If what I have posted is wrong, you can sue me for the shirt off my back . . . oops, not wearing a shirt today 😲

·1 year agoUnless those entering into the contract are both Australian Residents - residing in Australia - it cannot be legally binding.

·1 year agoI think you may be confusing "eBay" with an inexperienced and somewhat uneducated "eBay agent".
Obviously, the help pages don't state that you need a contractual agreement and to ask other members about what is actually required.
Likewise, no experienced eBay agent who knew what they were doing would ever advise you to to ask other members for the information.
Therefore, it looks as though you've simply received zero helpful advice from an agent who has no idea about eBay policies or requirements.
From here you have one choice... you can either seek appropriate advice through the channels suggested in the replies here, or you can ignore same and risk having restrictions placed on your account.
How you proceed is entirely up to you.

As already advised, the OP should get professional / legal advice.
And IMO, there's no way in the world the supplier for the OP's items is an Australian resident

Your listing certainly look very much like it
So if you aren't, you may want to not copy ads from other sites
Because even if you aren't right now, using such ads is likely to get you in strife with the eBay bots
Have a look at any of the number of threads on here where sellers have been pulled up for the same thing, or simply 'looking' like that is what they are doing
And do you intend to make potential buyers aware that this is what you are doing, but stating that you are dropshipping on the ad for each item?
The pleated dress is located in India and the description straight from a dropshipper/dodgy site play book

And, as said . even if it just looks like you are, the eBay bots will decided that you are

Do the clothing items meet Australian Standards for children's clothing?
If you are unsure, then the answer is NO.

Something you must consider is whether the items you intend to dropship meet Australian Standards.
A recent example that illustrates my point is the clothing item bought on Temu that didn't meet Australian standards for clothing 👇

If you sell clothing items, how do you intend to ensure compliance with Australian Standards if the items you list are sourced from overseas?
There would be liability implications if selling such items. Make sure you have insurance.

The pictures of your listings are all the same as shown on Aliexpress, from which dropshipping wouldn't be allowed. Likewise Amazon, Temu etc
Where is your supplier located ?

I'm not wanting a name, just something like 'online Australian retailer' or 'Chinese distributors'.
Anything you get signed by overseas suppliers probably carries very little standing in Australia, especially Chinese entities.

OP1 year agohi. i have talked to my suppliers and i have talked at length to ebay about what i need to do. ebay suggested i ask other dropshippers what they did getting an agreement
