Item never arrived.

Hi there,

Was wondering if anyone had any suggestions.

My order of a gold to ring from UK to Australia was due on 29th Sept, tracking number doesn't show it arriving in Australia yet, last scanned UK royal mail 8th Sept. Have contacted the seller and opened a refund request. I'm just getting stalling from the seller, this is a transcript of messages between us.

Nothing back so far, anyone had this happen to them? Any thoughts on how to handle this?

If you have already opened a case, you will need to escalate within the allowed time. 21 days, I think, but don't quote me on that.

As you can clearly see it is/was in the possession of RM and given the postage delays world-wide due to COVID, you have probably jumped the gun.

The seller can't do anything to expedite postage; all they can do is voluntarily refund you. If they don't want to do that, then escalation is now your only viable option.

I sincerely hope you plan on repaying the seller when your item arrives, as it almost certainly will.

Too soon, should have waited due to the Pandemic.

Hope you don't want to buy from that seller again - they've probably blocked you now.

It looks like the transcript of messages that I copied and pasted in my original post here between the seller and myself has been removed.

The seller asked for more time and I agreed.

THEN I received a message telling me he had looked into customs/border force Australia and that it was illegal for me to buy gold jewelry from anywhere in the world and have it sent to Australia, it was unlawfull and that I bid on it at my own risk, and that I entered in to a contract unlawfully......In short, I responded with a **bleep** are you talking about mate and sent him back a screenshot of the Australian customs webpage pertaining to "precious metals and gold imports"

Cos to me, that all sounds like seller speak for 'You're waaaay too much trouble'

Seriously, what is he going to do?

Seller sounds obnoxious.

Do not let the case time out - escalate if you need for a refund and if/when it arrives, you can repay the seller.

Mail from the UK is still being processed and is taking around 3 weeks at the moment, in spite of the pandemic.

If, for whatever reason, Customs does not let it through, you can still follow through with the claim. After looking at the Border Force website,you should not have an issue as gold jewellery is permitted. If it is over a certain value - $1000, a declaration has to be made (most likely by seller).

I wouldn't respond further to seller.

A positive and helpful response at last, I fear that the system removing most of my original post painted me in a very bad light. I looked like a very unreasonable person, with high expectations.

I have given the seller extra time, but when the last message arrived....I lost it.

Hope it works out.

There are definitely some countries which strictly prohibit certain items, including fabric and shoes (Italy) as protectionist measures, but in general, Australia is quite accommodating as long as you pay duties and GST if assessed.

I agree that I think the seller is trying to fob you off. Of course allow more time due to the Covid, but you must escalate before 21 days have passed or the dispute will time out and close.

I am a buyer these days and I am replying from a buyer's point of view.

You ordered something and you have been given tracking information about it, you can actually see that it is in the hands of UK mail. It has been scanned by them.

Occasionally we have buyers who post here who have bought items where a postage label has been generated but has not been lodged at a PO. That's not the case here.

The seller has therefore obviously posted the item, it is on its way. I think it is very unlikely it will be totally lost but yes, there could be a lengthy delay. My daughters once posted their sleeping bags back home, at the same time, same PO in London. One arrived a week later, the other 3 months later.

But as a buyer, I can understand you are concerned because you only get a month after the ETA in which to open an ebay claim.

Obviously things have gone south in the correspondence. The seller is right in that if things are seized by customs or you had to pay extra duty or whatever, that is your look out. I haven't seen the messages but it sounds as if they could have been more tactful. Whether a gold ring is in that customs category though, I wouldn't know. I wouldn't have thought so (apart from GST maybe) but it would be worth checking out if you have any concerns.

The main issue is you have already opened a claim with ebay. You can't close it and open it again later. Therefore you need to see it through and escalate before it expires. You'll no doubt get your money back.

What I would do though, once that happens, is message the seller one last time, just a brief note, to say you have been refunded but if and when the ring does turn up, you will contact them to repay them.

You have been too impatient expecting the item to arrive at the estimated time. "Estimate" is just a guess and due to the pandemic, everything is much slower. You have until 30 days after the LAST estimated date of arrival to open a case for not received. It is best to wait until that time is almost up (just a couple of days prior) before complaining that you didn't get your item. Once posted, it is out of the hands of the Seller, who cannot make it arrive any quicker. Sellers expect that buyers know the situation with the pandemic, and no doublt you will not be able to buy from this seller again.
