      <title>Ebay seller continually asking me to cancel order</title>

      <description>&lt;P&gt;I have made a purchase on Ebay, the seller has been repeatedly asking me to request a cancellation of the order. I have asked him why and asked him if its because he was over reporting his stock levels. He wont directly answer that question and instead just asks the same question again. I have said that if he doesn't have the stock, he needs to cancel on his end noting that he is out of stock. these things do happen but he needs to be honest about the reasons.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;My understanding is that sellers already have the option to cancel an order due to stock levels however by doing so they get a penalty for doing so. I am guessing that is why he is harping and pestering me to ask him a cancellation. I am guessing that the reason for this is ebay may be cracking down on sellers who cancel orders citing "user requested cancellation" when they haven't so trying to get me to say the words "yes cancel the order" in order to frame it in that way.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Would i be on the mark with this one?&lt;/P&gt;&lt;P&gt;also should i stand my ground and insist that either the item gets shipped or if it is not in stock cancellation be put through as out of stock? or just give in and let the seller bypass the checks in the ebay system to and cancel the order without penalty?&lt;/P&gt;&lt;P&gt;The item is only a $40 item and given it takes at least 20 days for the money to credit back to my card It makes little difference to me if it is canceled or not because I have to order it again.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;What i would say this seller was doing was listing an object on ebay then when someone orders the item just order it directly from the manufacturers website citing the ebay buyers address details. the manufacturer was out of stock of the item and has been for about a month and this guy showed he had stock.&lt;/P&gt;</description>

      <description>&lt;P&gt;I'd say you're right on the mark.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Let them figure it out - don't say yes.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;If they don't cancel, open an item not received case when available.&lt;/P&gt;</description>

      <description>&lt;P&gt;I'd say you are 100% correct in your assumption.&lt;/P&gt;&lt;P&gt;The seller has all the tools he needs for a cancellation if that is what he wants.&lt;/P&gt;&lt;P&gt;He doesn't need to keep contacting you, telling you to ask for one!&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;You say he isn't answering any of your questions anyway so I'd just ignore his messages, don't respond.&lt;/P&gt;&lt;P&gt;And do as imastawka says, just open an ebay claim if the item doesn't arrive by the due date-which it won't.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;And if he does cancel, citing buyer request, you can report that to ebay. I don't know what they would do, but at least he could not provide any written proof that you had asked, which is what he is after.&lt;/P&gt;</description>

      <description>&lt;P&gt;If they are out of stock, they will receive a transaction defect, similar to demerits, and their transaction fees will not be refunded.&lt;/P&gt;&lt;P&gt;Apparently they do not realize they have an alternative option, that does not attract penalties.&lt;/P&gt;</description>

      <description>&lt;P&gt;Hi Dave,&amp;nbsp; have they changed it, as far as I am aware, and what I can see with a quick look at the policy, is that a transaction defect&amp;nbsp; and non return of fees, only applies if an item is cancelled as out of stock.&lt;/P&gt;</description>

      <description>&lt;P&gt;Its a broad scope but my guess is that if Ebay find out that the seller has done that against the buyers wishes then there would surely be consequences. The seller has still like clockwork every day contacted me asking me to request a cancel to the order while ignoring or not addressing my question so as it stands now as suggested above im just going to ignore their messages then file an item not received claim.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;as for passing on orders to third parties, i know there are sellers doing that. I bought a drip style coffee machine a few years ago on ebay and when it arrived it had all the packaging and documentation in there as if it was ordered in my name directly from amazon on my behalf with a decent mark up too.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;</description>

It is one thing to find something you bought is cheaper on another site or in another store. Happens to everyone at some stage, I guess.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;But I think it makes some customers feel scammed if they actually receive a parcel &lt;EM&gt;direct&lt;/EM&gt; from another retailer such as Amazon. It's not a good advertisement for ebay either.&lt;/P&gt;&lt;P&gt;You'd think any seller would have the common sense to have orders sent to themselves then rewrap.&amp;nbsp;&lt;/P&gt;</description>
