Seller refused to cancel order

Hey everyone, I purchased a model car that was listed as a pre-sale, and the listing mentions it'll be shipped within 40 days of purchase. I then saw another listing (selling the same model car) where that seller had listed the date and said the item will be available in late October 2025.

I contacted the seller to cancel as I didn't realise these wouldn't ship till October, and he confirmed he won't have this in hand till October 2025, and said he will get a refund from Mattel (the company that sold the model car) and then cancel the order. He contacted me a couple of days ago and said he's gotten the refund from Mattel, and that he will cancel the order.

However, this morning, I got an automated email from Ebay saying 'the seller has refused to cancel your order'.

I tried contacting the seller, but he's not responding to me and seems to have blocked me.

Now, I'm not sure if I'll actually receive the item I purchased (as he says he's cancelled it from Mattel), or if I will get a refund. I know it was stupid of me to buy something without checking the dates first, but do I have any recourse?

The listing number is 396476395952.

Go to the link below, scroll to the bottom and ask for a supervisor.

They will be able to see the messages between you and the seller and have the power to cancel the order for you.

Go to HELP (top of page) and type in pre-sale policy:

seller has 40 days only

The seller has violated the pre-sale conditions.

Firstly, do as advised here – speak to a supervisor by clicking onto the link provided by padi. You may need to repeatedly type in that you want to speak to a supervisor.

Explain to supervisor that the seller is violating the T&Cs for listing pre-sale items. Explain that because of this violation, you wish to cancel the order. Ask seller to look through the messages (as already stated in this thread). Have the conversation ready as a pdf if possible so that you can provide it if the supervisor wishes. (May not be necessary but I prefer having even my unneeded ducks in a row.)

Once you’ve been refunded, you can report the seller. (Click onto the option “The seller has violated one of eBay's policies”.)

The seller has refunded me (still hasn't appeared in my bank account though, but I'm hoping it'll show up soon), thanks for your help everyone.

It may take a few days and the refund will go to your original funding source
