    <description>&lt;P&gt;Hi. I purchased a bed last Monday, wich was guaranteed to arrive by last Friday. I needed it for the weekend.&amp;nbsp; When seller hadn't posted by mid week I checked in and they said they hadn't guaranteed anything (despite listing saying free post and 2-4 days arrival by 1 August). I requested cancellation, seller refused.&amp;nbsp; I stated in covered by Buyer Protection but they said eBay won't help or refund.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Sure enough bed didn't arrive so I filed INR yesterday and asked for refund. I had to go out and buy a bed here given I needed it urgently.&amp;nbsp; Seller responded and said it will be sent next week?!?!&amp;nbsp; I've again explained ebay will refund due to failure to meet delivery guarantee. I've asked him not to send given he hasn't sent yet, but yes being obstinate.&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I'm just worried about what happens if he does send the bed, which I have no use for now. What will ebay likely do re: return costs? I can't afford to pay postage to return a bed and feel like I shouldn't have to given the seller refused to cancel - but will ebay force me to in order to get a refund?&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I've tried to contact ebay via chat but the chat on the website just keeps saying 'encountered a problem' and won't connect to an agent. I've tried Facebook chat but got no reply. Email also gets no reply.&amp;nbsp; And the INR says they won't step in for another 3 days.&amp;nbsp; I'd just like them to tell the seller if he insists on still sending the bed, I'll be refunded and he'll have to pay return costs.&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Help appreciated!&amp;nbsp;&lt;/P&gt;</description>

      <description>&lt;P&gt;OP, you have misunderstood; there is not a guaranteed delivery date. You’ll see next to the ordered item in your My eBay an &lt;EM&gt;&lt;STRONG&gt;estimated&lt;/STRONG&gt; delivery date&lt;/EM&gt; (EDD). Nowhere does it say “guaranteed” to arrive by [date].&lt;BR /&gt;&lt;BR /&gt;&lt;/P&gt;&lt;P&gt;If you ordered on 28th July, and needed it for the weekend, you were probably pushing it somewhat. When the need is urgent, you are really best off buying from a local store; buying online in those conditions might result in a delivery delay. Sellers can’t control couriers’ delivery time or Australia Post’s delivery time…&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;But let us take a look at the listing. Do you have the item number? (Not order number - the item number which should show on the listing itself.) It would be interesting to see the actual wording, the seller’s country of registration, etc.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I should also add that while you can &lt;EM&gt;request&lt;/EM&gt; a cancellation after purchasing, you cannot &lt;EM&gt;insist&lt;/EM&gt; that the seller cancel.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&lt;BR /&gt;You may be in a jam if the seller’s already despatched the bed. If it arrives within the EDD range (that is to say, by the latest EDD), you can’t claim INR (item not received), and equally you can’t claim INAD (item not as described) just because you bought another bed and you thought this one was guaranteed to arrive by the weekend… as that would be an abuse of buyer protection.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;But if the latest EDD has indeed come and gone, you should be able to open an INR dispute.&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Anyway, without saying anything further, please post the item number here and the responders here can take a look.&lt;/P&gt;</description>

I requested cancellation, seller refused&lt;/EM&gt;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I think we'd really need to see the ad before we could say for sure.&lt;/P&gt;&lt;P&gt;The dates that matter are in the ad in the part that says estimated delivery dates.&amp;nbsp;&lt;/P&gt;&lt;P&gt;They may be estimated but if an item hasn't arrived by the end date, you can go right into an ebay claim.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I'm getting the sense maybe the dates&lt;EM&gt; had&lt;/EM&gt; passed if your INR case was opened.&amp;nbsp; You wouldn't be able to open it otherwise?&lt;/P&gt;&lt;P&gt;Unfortunately, that seller will have been notified that a claim has been opened against them so what i suspect could happen is the seller will now rush out to post it within the time frame, then upload tracking details.&lt;/P&gt;&lt;P&gt;And you might be told to wait.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Personally, I think that, given you contacted the seller and explained the circumstances and that seller had not nothered to post it off after a few days, he should have just cancelled.&lt;/P&gt;&lt;P&gt;But the thing is, he didn't &lt;EM&gt;have&lt;/EM&gt; to &amp;amp; if he can get it off with tracking asap, I fear you may be stuck with it.&lt;/P&gt;&lt;P&gt;I doubt ebay will tell him not to send it or that if it is delivered, he will have to pay return costs because you've bought another elsewhere. But I could be wrong.&lt;/P&gt;&lt;P&gt;Let us know how you get on.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;And as for anything urgent, online shopping isn't the way to go, even if you're promised express shipping or whatever. Stuff goes wrong, deliveries are often delayed, you can't rely on things being on time.&lt;/P&gt;</description>

And had the seller at least bothered to ship within that window I probably wouldn't be pursuing this. But he didn't, and still hasn't - hence I'm pursuing it.&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Item number is&amp;nbsp;236201567467.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I finally managed to get a call back from ebay. They said I'm absolutely covered in this instance and that even if he insists on sending, I just need to file an 'item not as described' claim, given it didn't arrive in the delivery window, and he didn't even ship before then.&amp;nbsp; They said I'll l be refunded and he'll be advised he needs to organise and pay for the return.&amp;nbsp; &amp;nbsp;They advised me to contact him again and tell him what they've said, in the hopes he'll see sense and not 'shoot himself in the foot' by still sending.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;We'll see I guess!&amp;nbsp;&lt;/P&gt;</description>

Seller has now provided a tracking number - for an item that was delivered to someone in Tasmania over a week ago (I'm in Canberra).&amp;nbsp; &amp;nbsp;When I questioned it and said I'll be putting in a claim for a refund as soon as eBay allows me to later this week, he responded with '&lt;SPAN&gt;&amp;nbsp;"We aren’t giving you a refund stop putting your hopes so high and lying you haven’t received a refund this is A SCAM "&lt;/SPAN&gt;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&lt;SPAN&gt;Some people!!&amp;nbsp;&lt;/SPAN&gt;&lt;/P&gt;</description>

      <description>&lt;P&gt;The seller's received negative feedback since yesterday.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Has the tracking number been&amp;nbsp; entered in the dispute..... or just sent to you ?&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;If it's&amp;nbsp; in&amp;nbsp; the dispute, you're going to need eBay onboard with this as we've seen cases before when a seller's provided&amp;nbsp; a tracking number , any tracking&amp;nbsp; that shows a delivery, and they've closed the case.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;You may need to make it very clear , possibly&amp;nbsp; forceful,&amp;nbsp; to eBay that the delivery was to Tasmania&amp;nbsp; and not to your address in Canberra&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Good luck and let us know how you go&lt;/P&gt;</description>

      <description>&lt;P&gt;Today's update!&amp;nbsp; The bed actually turned up today. It wasn't sent until 31 July, and wasn't sent overnight so could never have arrived by 1 August.&amp;nbsp; But more importantly, the bed isn't even the model advertised.&amp;nbsp; It has the model name and number on the box - that model on the manufacturer website is a totally different model to the pictures in the listing. The model on the website which matches the listing pictures has a totally different name to what I was sent.&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;So, I've closed the INR and requested a return based on item not as described (due to late post and different model). He has to 8 August to respond. Soon as he refuses the return I can ask ebay to step in.&amp;nbsp;&lt;/P&gt;</description>

You have to wait until the date you're given to get them to step in. From here on in, forget all the previous bit about the bed being late and not posted on time, false tracking etc&lt;/P&gt;&lt;P&gt;That was all before the bed arrived.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Now that a bed &lt;STRONG&gt;has&lt;/STRONG&gt; arrived, the situation has changed.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Keep it simple. Take photos if need be to show the bed you received is &lt;STRONG&gt;not&lt;/STRONG&gt; the model advertised. This is a 'not as described' claim, nothing else. You should win.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;After it has all been settled, you can give this seller the feedback he deserves!&lt;/P&gt;</description>
