i am having the worst ebay experience ever. i purchased some auto parts 3 weeks ago and the seller is messing me around . firstly they didnt have the items but the assured me that they would be sent in a couple of days .a week passed and nothing . i messaged them again and was told they would send the items tomorrow ..... nothing . i messaged twice with no response . i raised a late delivery case with ebay and finally i got a response. they will send the items tomorrow . i closed the case and funny enough the items were not sent . i messaged them twice more 4 days apart and i got a response a week later . they will send the items next week . i want to cancel the order but because i raised and closed the previous case ebay will not allow me to cancel . how is this even legal . i dont have the parts and now it looks like ebay wont allow me to get a refund .

Never, ever close a dispute until you have complete satisfaction with the outcome.

Your only chances now are to open a dispute with Paypal (if you paid that way) or failing that try a chargeback with your credit card.

Oh and give them a well-deserved neg on their feedback to warn others.

It amazes me the number of people who have been eBay members for decades and still don't apprise themselves of the protections eBay provides or how they work.

You closed the case, which told eBay you were happy with the outcome

Avoid buying from dodgy sellers and especially avoid going along with what a seller says instead of doing what you need to do

When you do your own thing, you are not covered by eBay

You can’t cancel, only the seller can

You need to read the buying basics as all these things are things a long time member should be aware of

You have factual answers to your question

Your choices means you are not covered by ebay

Which you would have been if you followed the proper process instead of going along with a dodgy seller

As soon as I came to the part where you said the seller promised to send the parts and you cancelled the claim, I cringed.

Look, you told us they first assured you they would send the parts in a couple of days.

Then they said, next time you asked, that they would send 'tomorrow'.

As you have found, tomorrow never comes.

When you opened the claim with ebay and the seller said they would send tomorrow, why did you have confidence that that would happen. They had already promised twice before and never followed through.

You did the right thing to open a claim after the items did not arrive in time.

But never, never close a case till it is resolved, no matter what the seller says.

You are in control once you open a claim.

If the seller says they will send, well and good but you keep the claim open and if it does not arrive in time, you finalise your claim with ebay and get a refund.

The only time you close a claim is if you get the item or the refund.

So now you know.

You have lost your money. The seller knows you cannot reopen a claim or not via ebay.

If you paid via paypal though, you are in luck. I always pay with paypal. It gives you up to 180 days to make a claim if your item does not arrive.

If you did not pay via paypal go visit your bank immediately and see if they can do a charge back. I've no idea if you can, but can't hurt to try.

You are not going to get those car parts & you're not getting a refund via ebay.

If you ever strike trouble again, maybe come to the boards and ask as often people have suggestions to avoid some of the pitfalls.
