      <description>&lt;P&gt;I paid for t5wo batteries. None were delivered, simply a thin envelope with nothing inside that I signed for. Ebay said to send item back. there was nothing to send except the envelope. I sent pics to ebay. Ebay closed the case as i didn't send the item back. I will never deal with ebay again&lt;/P&gt;</description>

      <description>&lt;P&gt;If you received an empty envelope, and photographed the empty envelope.... why pray tell didn't you return the empty envelope?&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;When you have a deadline to return the item, failure to do so will always produce the same result - case closed in seller's favour.&amp;nbsp; So why did you ignore the deadline?&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;You also had the option of communicating with an eBay agent, providing them with proof of the empty envelope delivery, and then having them step in on your behalf. There would have been no requirement to return anything, and you'd have been refunded in full. I have actually done this myself in the past on 2 separate occasions.&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Edit: I should have also added that it's extremely dangerous to be purchasing batteries from an eBay seller. In fact, I'd advice against doing so at all costs.&amp;nbsp;&lt;/P&gt;</description>

      <description>&lt;P&gt;Great idea&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Not only did you buy from a beyond dodgy seller, but even worse, you tried to buy death trap batteries from that seller&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Maybe you have no regard for killing or injuring yourself or damaging your property with your attempt to buy said batteries, but there are other people. Their property and the resources of emergency services that have to come to the aid of those who buy these things&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;There should be substantial fines for those who sell AND buy or try to buy these things&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Aside from your dangerous buying habits putting others at risk, you COULD have followed their correct process to get a refund&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;No need to tell other members you are leaving. A person who tries to buy dangerous items from a dodgy as seller leaving is a very good thing&lt;/P&gt;</description>

It doesn't say they "will" take action - but rather they "may".&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Regardless of whether they choose to do so or not doesn't change the fact that they "may" take action.&amp;nbsp;&lt;/P&gt;</description>

If it was for an item not received, then you can go ahead and open a new claim for item not as described.&lt;/P&gt;&lt;P&gt;But if it was in fact a claim for item not as described in the ad, then it cannot be reopened and if you paid via paypal, do as casey said and claim that way.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;The seller you bought from has appalling feedback. If you ever do deal with ebay again (and I wouldn't blame you if you didn't) you absolutely must read the feedback first. It's useful on any site but especially useful on ebay. If you come across any seller with under 99% rating, check it out thoroughly as it is moving down into potentially risky area. No matter what ebay may say.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Unfortunately, ebay isn't the place to buy batteries, electronics or anything expensive, there are a fair few scammers and you've struck a&amp;nbsp; bad one. I personally do not know how sellers like that are allowed to keep operating on ebay &amp;amp; why ebay does not have some computer program to pick up sellers whose feedback falls this low, with recurring problems/comments.&lt;/P&gt;</description>

I think for those of us on the boards, it is second nature not to be that trusting before we buy.&lt;/P&gt;&lt;P&gt;But I think for a lot of buyers, they genuinely believe ebay is a safer platform than it really is.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I've talked to a few friends and family about this type of topic in general and in each case, none of them seemed to realise that buying electrical items or batteries etc on ebay could be a safety hazard. They assumed the items would meet Australian standards if they were buying on ebay, especially if buying from an Australian based seller, which is what johsommerla did.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;The sentence from your post that I have placed in bold, I think we need to apply to ebay as much as to buyers.&lt;/P&gt;&lt;P&gt;"Sorry, we didn't know" doesn't cut it. Ebay may not be able to pick up on a problem seller or scammer straight off but I think there is a lot of evidence that they aren't doing enough, not near enough, to make their site safer or to kick off bad sellers.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I have to admit, Casey's posts have been eye openers for me about just how bad things are and I do wonder if the time is coming when ebay may be asked to account for why they didn't do more.&lt;/P&gt;</description>
