I paid for t5wo batteries. None were delivered, simply a thin envelope with nothing inside that I signed for. Ebay said to send item back. there was nothing to send except the envelope. I sent pics to ebay. Ebay closed the case as i didn't send the item back. I will never deal with ebay again

If you received an empty envelope, and photographed the empty envelope.... why pray tell didn't you return the empty envelope?

When you have a deadline to return the item, failure to do so will always produce the same result - case closed in seller's favour. So why did you ignore the deadline?

You also had the option of communicating with an eBay agent, providing them with proof of the empty envelope delivery, and then having them step in on your behalf. There would have been no requirement to return anything, and you'd have been refunded in full. I have actually done this myself in the past on 2 separate occasions.

Edit: I should have also added that it's extremely dangerous to be purchasing batteries from an eBay seller. In fact, I'd advice against doing so at all costs.

That is one very rich scammer as looking at the feedback, it indicates that not everyone filed disputes with eBay.

johsommerla-8, the batteries would have been fake even if you received them .

That's what the scammer's feedback shows along with items not received.

You should have checked the feedback first, before buying, as there are many, many scammers on this site.

(eBay's not the place to buy batteries unless it's from an authorised seller/ reseller)

Most of the time, eBay does nothing about these scammers, even when disputes are filed, or even with pages of negative feedback so it's up to buyers to be extremely careful when buying on eBay.

$125 is a LOT of money to lose so if you paid with Paypal and it's within 30 days of receiving the envelope, file an

'item not as described' dispute and tell them you've been a victim of fraud.

All of which eBay could see if they really cared to look at the seller's feedback. !

I've seen this happen over and over with eBay asking buyers to send back empty envelopes or a feather they received instead of a $1000 item !

As a last resort, you could try a chargeback through your bank.

I'd encourage all new or inexperienced buyers to have a look at the following thread as an example of the above.

This was all reported to eBay well before the OP of the thread left the first of 32 negative feedback.

BUT eBay did nothing, left all of the scammer's listings up and more buyers were scammed.

If you look at the feedback, you'll see the buyers were asked to send 50 cent items back to the seller.

They also had to deal with fake tracking scams.

Most of it could have been prevented if eBay had acted on earlier reports, but they did nothing.

Buyers who have bad experiences leave eBay and tell everyone they know about these scams.

Great idea

Not only did you buy from a beyond dodgy seller, but even worse, you tried to buy death trap batteries from that seller

Maybe you have no regard for killing or injuring yourself or damaging your property with your attempt to buy said batteries, but there are other people. Their property and the resources of emergency services that have to come to the aid of those who buy these things

There should be substantial fines for those who sell AND buy or try to buy these things

Aside from your dangerous buying habits putting others at risk, you COULD have followed their correct process to get a refund

No need to tell other members you are leaving. A person who tries to buy dangerous items from a dodgy as seller leaving is a very good thing

And for any new or inexperienced buyers who may have taken the time to read the eBay Product Safety Policy and actually believed what they read, this is a warning....

This site is flooded with items that don't pass Australian Mandatory Safety standards and eBay seem happy to do

nothing more than collect their fees.

To ensure the safety and well-being of our members, eBay does not allow items that are banned, recalled or dangerous to a buyer to be listed.

eBay may take action - Removing the listing or other content, issuing a warning, restricting activity or account suspension

Rubbish.

Very common with Chinese dropshipping sellers who have numerous pages of feedback mentioning dangerous / fake items . Usually mentions ‘refunded by eBay’ as well, so eBay are fully aware of these fraudulent, dangerous items.

Scammers protected by eBay and more often than not they’re named as

Top Rated seller: One of eBays most reputable sellers

Everything above also applies to the Counterfeit Policy

The site is flooded with listings for fake, fraudulent items - reported over and over , disputes opened, negative feedback etc but in 99.99 % of the time, neither the fraudulent listings or the scam sellers are removed from this site.

Counterfeit or fake items aren't allowed on eBay.

These items are fraudulent

Counterfeit items, such as certain unauthorised copies or replicas, can reduce trust in our marketplace

My own opinion is that any trust in this marketplace disappeared a long time ago.

The quote that eBay "may" take action is definitely not rubbish. It's a fact. It doesn't say they "will" take action - but rather they "may".

Regardless of whether they choose to do so or not doesn't change the fact that they "may" take action.

I'll also add, please spare a thought for all the good, honest, decent Australian sellers who are trying to

sell the same 'NEW' items and are having to compete with all of the scammers' listings on this site.

Fraudulent, dangerous, fake, non existent items

Good sellers' items can barely be found amongst the thousands upon thousands of items listed by lying, cheating scammers .

New , inexperienced buyers don't have the benefit of long term knowledge .

It is sounding to me as if you must have opened a claim for an item that didn't match the description, otherwise ebay would not have been requesting you send the item back.

But if that is the case, usually the seller would provide a return postage label? If he had, you would simply return what you received, which was the envelope and brochure.

If you opened an ebay claim for item not received, the seller would have been able to show proof of delivery and would have won their claim that way.

We need to be very clear what sort of claim you actually opened. If it was for an item not received, then you can go ahead and open a new claim for item not as described.

But if it was in fact a claim for item not as described in the ad, then it cannot be reopened and if you paid via paypal, do as casey said and claim that way.

The seller you bought from has appalling feedback. If you ever do deal with ebay again (and I wouldn't blame you if you didn't) you absolutely must read the feedback first. It's useful on any site but especially useful on ebay. If you come across any seller with under 99% rating, check it out thoroughly as it is moving down into potentially risky area. No matter what ebay may say.

Unfortunately, ebay isn't the place to buy batteries, electronics or anything expensive, there are a fair few scammers and you've struck a bad one. I personally do not know how sellers like that are allowed to keep operating on ebay & why ebay does not have some computer program to pick up sellers whose feedback falls this low, with recurring problems/comments.

I don't believe there should be any fines for buyers who buy off an ebay seller in good faith. If a seller has such appalling feedback and is selling what are probably defective or counterfeit products, it is ebay's job to weed these people out.

We can see that johsommerla is fairly new to ebay. There is no way that he and the countless others who bought from that seller thought they would be getting a dangerous product.

And if they read the ebay safety policy before they bought, they would assume it was all true and ebay enforced mandatory safety standards.

I guess the question is-if people here think the buyer is criminally negligent for buying from such a seller, then where does ebay stand? Where is their accountability?

The sale is between the buyer and the seller, who should be equally responsible in both selling and buying such batteries

Sorry but 'I didn't know' should not come into the equation when lives are being put at risk

New or not the end result is the same when dealing with these death traps

And considering the amount of warnings everywhere (not just eBay) about the dangers of buying these batteries does not deter people from doing it anyway, maybe fines are the only answer

I feel your frustration. I think for those of us on the boards, it is second nature not to be that trusting before we buy.

But I think for a lot of buyers, they genuinely believe ebay is a safer platform than it really is.

I've talked to a few friends and family about this type of topic in general and in each case, none of them seemed to realise that buying electrical items or batteries etc on ebay could be a safety hazard. They assumed the items would meet Australian standards if they were buying on ebay, especially if buying from an Australian based seller, which is what johsommerla did.

The sentence from your post that I have placed in bold, I think we need to apply to ebay as much as to buyers.

"Sorry, we didn't know" doesn't cut it. Ebay may not be able to pick up on a problem seller or scammer straight off but I think there is a lot of evidence that they aren't doing enough, not near enough, to make their site safer or to kick off bad sellers.

I have to admit, Casey's posts have been eye openers for me about just how bad things are and I do wonder if the time is coming when ebay may be asked to account for why they didn't do more.
