I have sold a playstation console and games etc. The buyer states the console is not working properly. I give them options to return or give partial refund. The now say they have disposed of two of the items and still wish to turn up on my doorstep and with the rest of the goods and get a full refund - Should I do this?

They should not expect you to provide a full refund if they are unable to return all of the goods in the item.

How did they pay? Was it a pickup item? Was it just one listing or multiple listings? When they told you they had already disposed of two of the items, was that conveyed to you in an eBay message?

The answers to these questions will get you better help on this thread.

I wouldn't refund in full because 2 of the items was disposed off.

But a partial refund to keep peace you could based on how much it sold for and what exactly was disposed off and base that on what would be a fair refund price.

Is the buyer sure the console isnt working properly? If the games are scratchy that could also be the problem. Video Ezy will buff them for $2 a disk

This (that is the buyer's claim) makes no sense, especially if the "disposed of" items are not connected to their apparent complaint (eg games or other non-console accessories) and I would personally require all items to be returned for a full refund.

To clarify the situation, though, was this the console in which a question was asked re: postage, and the answer (posted on the listing) was: A last minute check has shown the tray still is playing up and as such I am not happy with proceeding with selling this item. I appologise for any inconvenience but I rather would not take the risk of posting this console. And was the member who asked that question the buyer?

Was the item a pick up or posted?

Of it was pick up then NO refund as they should have made sure they were happy with it prior to paying and taking the items.

If it was posted and paid via payal and they opened a dipsute then they would be told to return via paypal in the condition it was sent with all parts purchased to get their money back.

Why they would throw out parts is a worry.

I would be asking exactly what it is they would not be returning and if it was the 2 best parts to the listing then I would say that is all they were after anyway.

Working or not they need to return the COMPLETE purchase for a refund.

I would not do a partial refund in case they are only wanting to keep the 2 "disposed" of items.

On the listing it states 2 controllers may need replacing. They say they have thrown them away. My thought was if they tried them on the console and one controller worked but they recon the console freezes then why would someoen throw away the controllers before you asked for a refund. And the thrown away controllers wasnt mentioned until I offered a fulll refund on return of the goods. -Sounds a odd to me

I personally checked most of the games to ensure they worked prior to postage. I offered $10 reeimburse to cover a new console they refused.

I can actually understand if the console and games were in working order, that they might ditch the non-working controllers if they had others and didn't want to repair the ones that weren't working so well (if at all).

When did they contact you about this? If it is the console I referred to above, the left you a positive on the 19th so presumably were happy with the working of of things at that point and then ditched the controllers after assuming all was good. It may or may not be the case, but circumstantially suggests it may be a problem that developed after they received it.

Unless they open a dispute via paypal I would not do anything as they will have to return EVERYTHING you sent them to get the refund.

IF they open a dipsute Paypal ONLY view and take into consideration messages via the dispute process not ebay messages so get them to say in there that they have thrown away 2 parts to the purchase so you can respond there saying you can only refund on return of the complete purchase NOT parts of it.

Then if it escalated to a claim there is more chance paypal will find in your favor.

Let's not beat around the bush. You sold a console where two controllers didn't work but the third was usable.

It's not your fault if they've thrown the dud controllers out, as you stated clearly in the listing that they "may" work... not that they "do" work. The buyer shouldn't have thrown them out.

You also state that the games "look" good but that means you can't be sure if they work. So, if any game doesn't work, the buyer should have known that there is no guarantee. You worded your listing very carefully.

I think aslong as they return whatever is left that they haven't thrown out, they should get a refund according to what is returned. If 90% of things are returned, they should get a 90% refund. That's the technical way to look at it. You could just give a full refund aslong as they return the console and some games... depends on how you want to go.

The goods were posted and I stated on the listing that additional postage ie insurance is at the buyers cost.

Registration and insurance are for your protection and if you want it you have to only quote that amount, a buyer doesn't need to pay extra for registration or insurance as they don't need to if they pay with Paypal.

You would have been much safer selling with one controller and perhaps saying you would throw 2 that may be able to be repaired in free. If you were including them in the way you did then the whole thing should have been listed as spares or repair. You should also have tested all the games, not just some of them.

If the buyer knows what they are doing they will almost certainly win a dispute and if they then have to pay to return it to you I hate to thing what type of feedback they would leave you!

While I never believe in refunding unless I think it is warranted I think I probably would if I had miss categorised the listing as you did. You aren't out $51 dollars, you are only out the cost of postage as you already owned the item, you hadn't paid out money for it in order to sell at a profit.

OK, you're probably right as far as disputes. I do know that in a non-dispute situation, you can do a partial refund via just logging into the PP account and selecting the transaction. It might be best to try and work it out that way.

In saying that, the seller did word themselves fair carefully. They probably can be protected by PP, as they never stated anything except the console and one controller worked. It was the buyer's hope and perception that they would work. It's not good as a buyer... but unfortunately it's a risk with listings like that. You really do need to make sure things work before buying them.

Final result of this sag:. I gave a full refund, they send back the goods less two controllers they threw away. I test it all and it works fine, no problems. I send a message stating this to them they then say they never tried any of the games they bought from me, they say they only tried one game they bought elsewhere and it didnt work.
