I don't even think it is an authentic mimco bag but an imitation. Seller is not interested in helping me and claims it was new. Not sure if I can do anything about this. I'm not happy as I paid $115 for it and it broke!!

If you paid with paypal and it is less than 45 days you can open a Not As Described dispute.

Unless you can get written proof that it is a fake do not mention that or you will lose the dispute.

In your position I would open a not as described case on the basis that the handbag has broken after a few days use, which is inconsistent with the quality of the brand and that you think it may be a second or a replica.

If you purchased from an Australian business they are required by law to accept returns and refund or replace if the goods are not of acceptable quality.

I would never insist in a paypal dispute that an item was fake, unless I had written proof from the manufacturer or a reputable authenticater. Whilst you may suspect it is not authentic, a paypal claim is not won on accusations alone.

In a paypal dispute clearly outline where the bag has broken and upload photos of the damage to support your claim.

That sellers items practically scream counterfeit.

JMO but I'd be contacting & telling them they had 48 hrs to refund you in full or you will be reporting to Online Fraud,which I would do anyway as a matter of principle.

I'd also be leaving them a neg re selling counterfeit items.

I pity the poor buyers who have been conned over the 'Gucci' sunnies & the 'Mimco' watch.

I would not advise threatening a seller that if they don't refund you will report them to the police, IMO it may be considered extortion - even if they are selling fake goods.

If the seller reports any message like that to ebay, your user account may be placed in jeopardy.

To get your funds back, use the paypal dispute process.

If you are convinced the goods are fake, report them to the online fraud police without advising the seller, and the police will take it from there.

Cats-threatening a seller with Online Fraud & stating that I would do that anyway as a matter of principle,could in no way be considered as extortion.

Also,under ebay policy,extortion only applies to feedback ie

Threatening to leave negative or neutral feedback for another member unless the other member provides goods or services not included in the original listing is not permitted.

Buyers are not allowed to threaten sellers with negative Feedback, neutral Feedback or low Detailed Seller Ratings in order to obtain goods or services not included in the original listing.

Extortion is a criminal offence.

Best avoided in any scenario where money is sought for not reporting a criminal act such as fraud - even it is to do with refunds on ebay.

If you think someone is defrauding you, you should report the alleged crime, not use it to leverage a refund.

Encouraging people to threaten any sellers in this way may also send out mixed messages to others that lurk on these boards too.

I cant tell you now, the Gucci sunglasses they sold are totallyfake.

I have never heard of mimco being replicated but that certainly doesnt mean it hasnt.

It seems nowadays that anything will be copied, even if the full cost is only ten bucks somebody will be happy to copy it and sell it to the gullible for five dollars.

Sometimes the ebay sellers know very well the items are not authentic, sometimes they actually believe that they are buying the genuine item from a wholesale site just because they are sold to them with assurances they are authentic and because the manufacturer also owns the factory next door that churns out the very real looking tags, labels, certificastes of authenticity and dust covers etc.

Very very true pj, unfortunately. They are even chruning out fake receipts for Chanel,LV ,Hermes & other brands. The counterfeiters have become very sophisticated.

Replica Mimco bags most certainly exist. I accidentally purchased one off eBay. I got a partial refund and got to keep the bag (not that I want it. I just kept it for reference while reporting it to Mimco). I have sent photos and emails to Mimco. They have sent the information to the right department and the situation is being investigated. The replica Mimco bags are very obvious. Often they have different lining, or a faux leather tag sewn to the inside of the bag that has "Mimco" printed on it. The smell of the counterfeit bag is horrendous. It smells like very nasty chemicals (fishy). If you're worried about purchasing replica bags, look for the "po number". It's a small black Mimco tag inside the bag that has "PO" and some numbers printed on the back of it. I'm not sure if all Mimco bags possess this but all 7 of mine do and all the bags were purchased from different time frames. Mimco usually has great sales and discounts on their website and in their factory outlets. I'd stick to those in the future. I've seen heaps and heaps of "wholesalers" through numerous sites, selling zip top turn lock bags, or worker bags for less than $50 a piece. The bags look very authentic too. I wouldn't be surprised if some of those nasty fakes made their way to eBay. Very disppointing! Here is a photo of the counterfeit bag I was sold. While it looks pretty close to the real deal, once purchased, you'll notice the lining is significantly different, the "Mimco" that is embossed in to the bottom of the bag isn't as deep, the turnlocks are flawed and the "Mimco" is printed on them instead of engraved, the care kit came in a different plastic pouch to the authentic ones, the dust bag was plain white, the bag STINKS, there is no PO number, the overall size is a little smaller, the handles are shorter, the leather is fake (PU), and the bag is much lighter than a real one.

It's frustrating that I've been reporting fake Mimco bags to eBay (including the one that you bought!) yet they never get removed. Because eBay aren't doing anything about it, the listings remain and people are buying counterfeit bags. The buy-it-now price is a dead giveaway, but they often look fairly convincing in the photos. Any bag shipping from China/Hong Kong is definitely a fake.

I've also reported this listing ( http://www.ebay.com.au/itm/MIMCO-Metal-Button-Zip-Top-Snow-Bag-/201081578626?pt=AU_Women_Bags_Handbags&hash=item2ed1656482&_uhb=1 ) as these bags are DEFINITELY fake.

You need to provide eBay with proof that they are fake. eBay can't just take your word for it, they are not professional authenticators, for all they know you are a competitor maliciously reporting their products, or someone with a grudge against them.

Good grief.

That is a worry, because those bags on ebay are not cheap. I don't know a lot about high end handbags, I guess, but the ad looks very business like and the seller is in Victoria. At a guess, most people seeing that sort of ad would assume that, for the price, it was genuine and from someone who had access to wholesale quantities.

I do hope the companies to get right onto any counterfeit ads, it is so unfair to consumers.

I reckon it's a lesson for us all. Stop buying overpriced "designer" items, as even if they are genuine they are not worth the price you pay for them. I once worked for a drycleaning company, and there were certain big clothing brands that regularly fell apart during cleaning.

If you really search through ebay, or op shops, you can find some wonderful clothes and accessories for very little, that look great and stylish. Money does not necessarily equate with style. I don't buy big brand names on principal. I get compliments all the time, and my outfit might have cost a total of $30.
