OK, I looked at the sellers feedback and it really is very good. This does not seem to be a common problem for them, especially compared to their volume of sales.(from memory, yours is the only case, and they seem quite happy to refund if a customer complains of a fault)

In the absence of further details, I can only assume that the seller did send your items and they were able to prove this to PayPal.

If that is the case, your anger is misdirected (although understandable).

It's really the carrier service that you need to be angry with.

Look at this from the Seller's perspective. They have an unknown costomer claiming they never received an item that they have sent and their delivery company is telling them that they have delivered it.

For all they know, you are not being honest about the receipt of the goods.

Now look at it from PayPal's perspective. Similarly, they don't know you either. All they have is your allegation that you did not receive your items, but they have proof from the seller that they did send them and the delivery carrier has confirmed they are delivered.

With the facts available at this stage, i do think that the negative feedback given to this seller was unfair.

The bottom line is I never received the goods I paid for and if it is the Courier Company's fault, then surely the Seller who engages that Company to deliver their goods must shoulder some of the responsibility. Think of it from my side, I paid for these goods in good faith, I have 100% feedback! I have had over 800 goods purchased from E Bay and nothing has ever been stolen from deliveries to my front door. I have instigated a complaint against the Courier Company with the Department of Fair Trading and if this is unsuccessful I will then go to the Police, I am the one that has been wronged and I will not stop until I receive my goods or my money refunded!!

Hi I'm sorry to hear this, I have had a few problems myself lately. If paypal found in the buyers favour I am almost 100% sure they would have posted and have proof of this.

I am not sure where u live I am in Melbourne and have now got aus post looking into the delivery guy because strange things have been going on and I have tracking numbers so I know its not the sellers.

Funny thing is its the ones without tracking that are turning up without problems.

I have also just learned about locker boxes that are free to use and u get a sms to say your parcel has arrived. It open 24 hours and your post sorting location. and you get a sms code to safely get your goods and there is no way that it can go missing and if it did its 100% aus postproblem.

I don't know how much cash we are talking about but it is certainly possible to get your money back from Paypal however it is going to require a lot of hoop jumping so you have to decide if it is worth it.

First you need to ring Paypal and tell them you wish to challenge their decision, if they won't allow you to proceed ask to speak to a supervisor. Tell them you have not received the parcel and nobody at your address has signed for it and you are prepared to provide a Stat Dec confirming the fact. If they still say that is not enough you will have to go to the police station and report the parcel as stolen, once you have a crime number phone Paypal back and tell them you have that as evidence and you would like a refund within 24 hours of them receiving the faxed report.

If they still refuse tell them you will be putting in a complaint to the Ombudsman.

In all likelihood they will action a refund on a discretionary basis, without admitting liability. It is then up to the seller to argue with Paypal over if they have seller protection so Paypal fund the refund or if they have to cover it, that is not your problem.
