Advice needed RE: Pre-order items

Hi,

I have recently made a rather expensive purchase for a pre-order item (the item will have a worldwide release in a few months) as the pre-orders local to where I live were sold out within an hour. I wanted to know if there was any protection offered by eBay (I'm sure the standard 45 days will have well and truly expired by the time I should be receiving the item) if the seller doesn't send the item once it is released?

The reason I'm asking is that the listing is no longer there, with the message "We had to remove this listing from the site and you're not required to complete the transaction. If you've already sent payment, the sale should process as normal and you don't have anything to worry about. If you have any questions about delivery, please check tracking or contact your seller. If you run into any trouble along the way eBay is here to help. Please visit the Resolution Centre to help resolve any problems you may encounter."

Just starting to feel a little bit concerned that the seller will (potentially) be able to easily get away with not shipping the item at all.

sorry but you are playing with fire. If you have paid I would be claiming it back ASAP. You said yourself the item will not get to you under 45 days so you risk to lose your money and paypal will not be able to help you. If you are going to wait in hope then at least file a non receive dispute on day 40, You can then escalate it which will give you another 20 days

If the item (DVD?) is not due for release for a few months the seller was doing the wrong thing by listing it. The listing would have been removed by ebay as it was against the rules.

Pre-order items must be shipped within 21? days to be within ebay rules.

Open a claim if the seller will not refund your money. He cannot provide proof of posting so you will get your money back.

Thanks for the advice - there are thousands of such items available on eBay however, many of which have shipping outside the 45 days (due to it being impossible to ship before the seller even has the item). An example of a similar item:

The seller will receive the item on September 9, and ship it after then for the item indicated above.

I had thought perhaps eBay had some non-standard kind of security for such items, but it doesn't sound like that is the case.

Since I've never seen one of such items removed before, I think there is something suspicious going on here, and will see what I can do.

Should I simply email the seller and ask for a refund - then see if he responds or not? Am I even within my rights to ask for a refund?

that is not an eBay 'legal' listing, as he is quoting `1 day handling, and only mentions shipping mid September in the description, but quotes postage as arriving on or before 31 July !!!!!

The only time a seller can list something with a longer handling time than 20 days is if they are the manufacturer of the item and they have pre-approval from eBay, usually withheld for special promotions.
