Your seller is an idiot. If they refunded you by direct debit (which is perfectly safe for you) then you could still open a Paypal dispute and the seller would lose so you would get a refund twice, also the seller would not get their Paypal fee back either.

The reason they want to do this is they think they will avoid a defect but it wouldn't stop you trashing their stars which would give them a defect anyway.

Can I find out what is the protocol when a seller has informed me they are out of stock, item has already been paid for via PayPal and seller has informed me they will refund me my money.

As yet I've not had a refund, do I cancel the transaction to get the ball rolling?

I want something showing in eBay or PayPal that this seller has reneged on his obligations as a seller to have stock and to issue a refund. (last feedback for this seller stated that refund was given for the same item, so they knew they didn't have stock)

No, you cannot cancel the transaction.....only the seller can do that.

If you funded the payment with a credit card or Visa debit card the refund will go back to that account and will take several days to show.

You can check if the refund has been initiated by going into your paypal account and finding the transaction. It will show in the Status if you ave been refunded.

if they refund you in full through paypal they will most likely receive a defect. you can leave appropriate feedback too which will also be visible on their account.

Exactly the same issue I am currenty going through. Seller does not have in stock, I request refund to my PayPal (From which I paid with available funds) but seller insists on refund via direct debit. I have contacted PayPal and they are sorting it.
