@pangatp wrote:
Sadly to say ebay chose to not refund due to eBay Premium Service seller providing false fraudulent delivery details. One bad egg that knows how to use and abuse ebay policies to there advantage is enough for me not to buy here any longer as the money is not a factor but the principle of the fact that buyer protection as advertised is a load of **bleep** and false advertisement. Thank you all for your replies and trying to help but I hope ebay burns in hell

I refer back to my first post....

The seller has to prove that they sent an item to your delivery address, they can't just supply a tracking number and be done with it.

Like yourself, I recently purchased a couple of small items, the total price of which (including postage) was less than the postal service that was advertised.

Not long after my purchase, a tracking number was uploaded to eBay. My first thought was wow, that seller must be losing money on purchases like mine... (as opposed to, wow, that must be dodgy). Cut to a few days later and I checked my PO box and there was the package, with the tracking label that matched the number they'd uploaded.

Moral of that particular story - you can not assume that just because the price you paid is less than the total value of the goods and services being offered, that the seller is scamming.

I wonder, if the package had been delivered to your doorstep, but before you could go outside and grab it, you saw someone run up the driveway and steal it, would you still blame the seller? I would certainly hope not.

I put to you that they only reason you currently have the "luxury" (for lack of a better word) to make your assumptions and blame the seller, is because you currently don't know what actually happened. Why not contact AP and make the necessary enquiries - at least you might get some more information rather than continue with assumptions. If it turns out the seller did do something dodgy you can report them for online fraud (but to be honest with you, I'm not convinced the seller is dodgy - why? Because I can't understand why a seller of that volume would go to so much trouble to scam about $1-2 (after all associated fees etc are paid). I can't imagine anyone doing that sort of thing when it the vast majority of the time it is quicker, simpler and better to just refund and move on - you may suggest if they do this on <$5 items often enough they'd be making decent money, and the answer is no... They really wouldn't. Even if they did it 100 times a week (and actually managed to maintain an eBay account with that many dissatisfied customers, their net criminal gain would be... $100? $200?

Logic dictates that sort of practice would be unfeasible on all counts.

When you don't know what happened to the package, is it genuinely fair to assume the seller is to blame, and/or did something dodgy? Maybe it's Australia Post that did something dodgy? Maybe it's a random passer by, maybe not. Near as I can tell, what do you know for absolute certain (and I do mean absolute, as in you have 100% irrefutable evidence), other than you don't have the item, and the online tracking doesn't match your suburb?

Item not received case

Hey, I recently purchased some batteries from a seller and shipping was Standard Postage (Australia Post Parcel Post Parcel + Signature). The estimated delivery date came and gone so I opened a case of item not received. The seller then added tracking information with Australia post in the case which was for a totally different suburb to which I live which is my shipping address. Obviously the seller has either shipped to the wrong address or is giving shipping information for someone else purchase for mine. Now the seller wont reply in the case and it tells me If you don't hear back by Feb. 1, or if there's a problem, you can ask us to step in and help on that day. It is now the 1st Feb and all I can do is send message to seller or close the case. I have no option to ask ebay to step in. Could this be a loop hole this seller is using by adding tracking information even though it has nothing to do with my order to prolong and kill the process of the item not received case? Any advise, help would be appreciated. Thanks

When your item didn't arrive by a certain date, did you actually attempt to contact the seller first or did you go straight to opening a case?

Also when you received the tracking number, did you contact the seller to let them know that perhaps the number they supplied is incorrect? Are you actually going to let the seller know this?

Sounds like you've gone straight to opening a case rather than first letting the seller know you hadn't received the item !!!

ebay gives dates for arrival times and give you the option to make claim if item not arrived by that date.

Doesn't matter wether I contacted the seller or not before opening case by opening the case is contacting the seller and allowing ebay oversee th contact made and replied to.

The question is lack of tracking number before case is opened and the tracking number supplied after case opened is totaly different suburb to the shipping address on the order.

If the seller supplies a tracking number the seller will win the dispute, especially if the tracking shows that the item was delivered.

If you had handled it differently you might have won. As it is the dispute will probably be closed by ebay in the seller's favour and you will have an almighty fight to get it reopened.

Just because ebay gives you the option to open a dispute, it does not mean it is the first action to take.

I will add that eBay delivery estimates are just that - ESTIMATES.

And don't normally include Public Holidays or Australia Post's own estimates.

So, by all means ring eBay, but it seems you are a buyer who many sellers wouldn't want to deal with anyway. If, as you have stated, your first point of contact is a dispute, which can damage a seller's standing and ability to sell. An email, at least, would be more likely to get a response. Once you've trashed a seller by opening a dispute there is little incentive for them to try to help you with the issue.

Lyndal, btw, is a buyer only, but a lot of us are sellers who you won't be troubled buying from. Not counting the non-posting lurkers.

I am a seller, and I will say that while I do know that for buyers opening a request is the simplest, easiest way to alert the seller to an issue and I tend to look past the method, on the flip side, for many sellers this is a new and less desirable form of communication. Many won't even see it as communication, but rather the equivalent of opening a PayPal dispute with no prior communication, something sellers are used to viewing as suspect action, to be perfectly honest. You can disagree with that take on it, but disagreeing with it won't change how a lot of sellers react to the notifcation that a request has been opened.

The next issue is the accusation of "non legit tracking number".

Here is what a seller needs to provide in order to have a request closed in their favour - I have highlighted the most relevant point.

If a buyer reports that an item hasn't been received
You're protected from losing a case if you send an item within your stated handling time and provide valid tracking information before you or the buyer asks us to step in and help.
Tracking information needs to include:
A delivery status of "delivered"
The date of delivery
The recipient's address
Proof of signature, for items with a total cost of $750 or more

This means that the seller has most likely provided valid proof to eBay that the tracking number is for a package that was addressed to the delivery address provided by you - the delivery status showing a different suburb is an Australia Post issue, not a seller issue.

If you consider that, then try to see this from the seller's perspective for a moment, from where they sit they have more than likely shipped the item to your address, can see it shows "delivered" on the tracking information, but then with no prior communication, a request is opened claiming non-receipt.

I believe you, but I can also see that you haven't given the seller very much to base belief on - you may not like to hear that, but I am just trying to be frank and hopefully help you get the best outcome if a situation like this ever occurs again.

Thank you for your insite and encouraging words.

It's ok, as I said I know how frustrating these situations can be - my best suggestion now would be to try and communicate directly with the seller, which can be either through the resolution centre or in standard eBay messages.

Let them know that you understand the item was shipped and shows as delivered, but that unfortunately it wasn't delivered to you. Since the tracking has a 'delivered' status, as you are the intended recipient, you would be able to contact Australia Post to lodge an inquiry - I'd also notify the seller of this, and request that they also contact Australia Post, and/or provide as much assistance as possible with the inquiry. They may understand the situation a little better, and hopefully provide help or further options to resolve.

You purchased Lithium batteries. If you are interstate from the buyer, they would have to be sent by road. They can't go by air. EBay's ridiculous estimates don't take that into consideration. Weekends also count as business days as far as ebay is concerned. Therefore, they will probably take a bit longer than other items to arrive.

Estimates are just that, an estimate. They are not called definites. Did you know that the seller has no control over how long something takes to arrive? Thankfully my buyers are decent people and they contact me via ebay messages, rather than going for the jugular by opening a dispute if there's a problem. Did you know that eBay can read the messages between you and a seller? Therefore, your reason for opening a dispute sounds more malicious than anything.

I hope all this angst is worth it and that you get your refund for $3. Welcome to a lot of people's speshul lists.

My advise, if you lose the case, give the seller a negative. They may have a response to your negative, at least you are letting other buyers know this seller is dodgy.

As others have been saying, not other sellers are this bad.
