Is this an unpaid item? eBay charge the FVF as soon as the sale is made, and opening / closing the dispute is generally the only way to get a credit on the fees. It can be frustrating, I know, when you're billed for an item that hasn't been (and won't be) paid for, but I suspect eBay won't be making changes to this system any time soon.

After a full 4 days have passed since opening the dispute, you can close it and get a credit of the fees - if payment for the fee has already been made, and you don't wish to have the credit on your account, you can request a refund to be issued: http://pages.ebay.com.au/help/sell/refunds.html
