yes, probably (unless they didnt go through the 'proper procedures)....when this happens to me, I refund all but 10c (thereby resulting in a partial refund)

It can do, as eBay will sometimes just treat it as a cancelled transaction due to being out of stock, although there being messages between yourself and the buyer (via eBay) before the refund can sometimes prevent it. If you do get a defect for out of stock, you should (eventually) be able to convince eBay to remove it.

What I usually do now in these cases (after offering to either send a replacement or cancel and refund, and they opt for refund) is tell the buyer that I'm cancelling the transaction, which will in turn trigger a refund and that eBay may ask them to confirm that a refund was issued. Then I use the "buyer asked to cancel" option.

I've only done 2 full refunds due to non arrivals and didn't receive a defect either time. There was no dispute open though, so not sure if that made a difference. They were awhile ago though, so not sure if anything has changed. It might be different if you choose to cancel to get your fees back (which I didn't as one was a $10 sale and the other $20).

That said, others have probably got defects for doing exactly the same thing, so it's hard to say either way. I think the other suggestion of witholding 10c, or even 1c so it's a partial, is a good idea.

I refunded someone when they did a return about a month ago and I never got a defect. They didn't go through the system, just discussed it via a message. I had to cancel the transaction and ebay automatically refunded the full amount to them when I did that. I can't remember what my choices were when I did the cancellation.
