Please don't rant in capitals... it's hard to read... If you want some constructive advice, just ask. There are plenty of knowledgable members here who are usually happy to give advice 🙂

What is the package status as of now?

In some cases, this part of the MBG will (or should) apply, which means you may have success appealing the decsion and defect - I know it relates more specifically to refused delivery, but when an item is sent via Click & Collect (Woolies etc), the buyer isn't eligible for the MBG if they don't collect, so logic would generally dictate that if a package spent any time 'awaiting collection', similar policies should apply.

Generally, the buyer is responsible for accepting the item when it arrives. If the buyer refuses delivery, their claim is not eligible for eBay Money Back Guarantee.

Exceptions:

The buyer can provide, via written proof from the carrier, that they refused the package because it arrived empty or was damaged in transit
The item arrived COD because it didn't have enough postage on it

I just realised that's almost a direct contradiction of one of the other policies in the MBG.... (I shouldn't be surprised, but anyway).

Further up the policy page, under 'not covered', it states - "Items damaged during pick-up or postage"

So, if items damaged during transit aren't covered, what difference does it make if the buyer refuses delivery and then provides written proof that the package was damaged in transit?

Maybe it's like some kind of Schrödinger clause - if the package is damaged in transit, the item exists in a state of being both damaged and not damaged and therefore the previous clause does not apply?

There's another contradiction in their MBG policy where it states returned items must be sent back "in the same condition it was received".

That is one of the biggest contradictions.

I've stated in other posts where a buyer claimed SNAD, said I listed the size wrong. I accept the return, despite my photo showing the correct size, he sends a photo of "an inner tag" which had a different size. I paid for the return post, he sends back a totally different item, gets his money back and my item.

When I brought this to eBays attention they simply said"well the buyer returned an item so we must refund them". I said but he didn't return the same item, he returned a badly worn and faded item" eBays response " well we don't physically see the item so we have to go with what the buyer said" PFFFT!!!!

I assume it is that, given your vast experience in selling and your feedback which ONE MGB won't affect. Either that or you haven't bothered to work out how such claims can be addressed.

Neither do I; P - But I had the blue displeasure of buying something from over there awhile back - a breakable just chucked in a plastic envelope with 1 stamp that arrived broken. OTT post for a parcel & didn't give a flying!

I've had the opposite happen - item marked as delivered on a day (a Wednesday back in the middle of November) when no mail or parcels were sent here, with proof (next door's CCTV, aside from me looking out the front all day waiting for the item and any other mail that may turn up) that no posties, couriers, bikes or vans were anywhere near the property the entire day (nope, not even regular mail). No refund as the seller had tracking which said "Delivered" on it. -$600, and there is no way whatsoever a massive brown cardboard box the size of a guitar amplifier could simply vanish into thin air. Australia Post "apologises" and tells me to pay for insurance next time instead! I'm shocked I managed to get a copy of Wily Wars (Mega Drive game) here via regular old Parcel Post!

its post protocoles. If item not delivered then its the sender who has to dispute. If its "delivered" then it becomes the reciever's issue. Its unfortunant in your case it was an expensive one. Its a fact of life that mail will be lost from time to time. As a seller i accept this as a risk and pay for lost mail.
