He bid he won he pays the fact he won another item from another sell is no excuse.

He should pay or cop the strike. In this case its clearly the buyers fault unless he has a better reason. Just let him make the choice.

Buyer bid consistantly for an item and won. After winning another auction he has asked me to "second chance" the item because he won similiar elsewhere. I have pointed out the unpaid item policy for him to read and get back to me. He has now asked that I go to "resolve a problem" and cancel the transaction. Should I wait and put in the unpaid item claim or should I just cancel the transaction and be done with it? I will often bid on items in more than one auction but never bid in a way so as to win more than I need. Any thoughts on what I should do.

How can you bid in more than one auction with the intent of not winning? Thats almost shill bidding just to push the price higher. With that statement made I would just cancel the transaction...

I would not send a mutual cancellation, if they can't bid responsibly could you trust them to tick the right box? If they don't then your FVF refund is lost, they can still leave you a neg and they do not get an unpaid item strike so you are letting other sellers down.

I would open an unpaid item dispute and then they can either pay up as they should or get the strike they deserve.

Did they even offer a small payment to cover your expenses and wasted time? I bet they didn't!

You may have misunderstood me. If I am looking to buy an item I will bid to a reasonable amount. If I do not win, I bid on similiar item looking to win. I would never auto bid on two auctions at the same time.

Back to my case, so it would be ok to set up auto bidding and just take the cheaper win which is most likely what the non paying winner is doing to me. I feel somewhat cheated that the winning bidder will not pay but they have also cost a winning bid for someone else who ran second place. is that fair to do or in the ebay spirit?

If it is that sale then you most certainly should open an unpaid item case.

It is easy to set up bids on multiple items without risking winning more than one. You need to use a sniping service that allows group bidding, it will bid on successive items up to your max and will stop once it wins one.
