Hi there.

So I sold this $8 watch and it was lost in the mail. The buyer didn't pay for insurance but I offered him a refund anyway. He refused that and says he would like a replacement. I told him 4 times that I am not a shop and do not have any replacements. He just couldn't understand that. Now he says he will report me.

Is this fair?

I am getting so sick of ebay and how many problems arise.

Thanks

he cannot "report" you if you refund through the refund link in your PP account. There is nothing to report about accept item not received, but the moment you refund that is not possible. So do it NOW, refund the whole amount including postage. If you do not, he will make claim and get the full refund anyway.

Whether you refund or not, they will more than likely neg you any way as you can not replace it.

If they do neg you call ebay and get them to read the messages and they MIGHT remove the neg feedback.

Let them report you as there is nothing they can report you for anyway.

ebay will just tell them they have contacted you just to please the buyer, even when they don't.

One thing eBay/PP could look into is to have their staff automatically (after checking) remove negative feedback when an item is fully refunded through being lost in the post or something out of the seller's control. As a seller, to have that peace of mind and cooperation from eBay/PP would help with seller confidence (and less complaints here) in the long run.

That would actually create a massive loophole for shonky sellers.

They could put up an auction, then refuse to sell to the winner... but do it by pretending to "post" the item, pretend it was lost in the post, then refund the buyer. In this kind of situation, the buyer deserves to be able to leave non-positive feedback to warn future potential buyers.

For items that I send by courier (AAe), if an address is too rural for them then they will only deliver as far as the local PO which work out the same as if you used your PO box address..

But anyway that is all just academic anyway because if the seller cannot even reply to you then you really don't want to trust them with deliverying an as described product.

As soon as you are able I would open a PP dispute 🙂

The general consensus seem to be that eBay do nothing about non performing seller reports; even when seller flatly refuses to sell. I imagine in this case it cannot be proved one way or another if the OP sent the item. But there is no doubt, the OP has to refund the whole amount paid.

If she gets NEG she just has to answer: item lost in post, full refund given. But I do not think eBay would remove a NEG in this situation; the buyer has a right to be unhappy about not getting their item.

Reporting a seller for non performance is not the same as a dispute. It used to result in a policy violation being recorded against the seller's account if found to be true. Current scuttlebuck is that ebay no longer do anything with these reports but having fully refunded a buyer for an item lost in the mail the report would be dismissed anyway I am sure.

I suspect the buyer perhaps thinks the lost in the mail excuse means the seller did not get as much as expected so didn't send anything. I am sure it happens quite often which is why they asked for a replacement, not a refund.

Either way it is up to the seller if they refund or replace so just issue the refund and if they neg you it isn't the end of the world, you can follow up saying that a full refund was given straight away.

To avoid this happening in the future why not post using click & send for parcels and register large letters, the satchels work out cheaper than regular parcels or red satchels and are enough for Paypal if you lodge them over the counter.

What absolutely wonderful advice. What does a PO receipt prove other than a parcel was posted on a certain date to any address in a suburb, as proof of having sent anything to the buyer it is a non starter.

Saying that would just cause the buyer to go through Paypal and get a refund and if it were me and you were so rude I would go straight to my bank and do a chargeback so the seller had to pay the money back plus a $15 charge.
