@oddsandendsoz wrote:

An update to this. Australia Post have 'closed' their investigation in to this and concluded that 'they have fulfilled their contract' by delivering the item. They confirmed with me today that the buyer had taken the parcel to the Post Office but they concluded there was no evidence of tampering (it is very strange they could come to this conclusion given the box had been opened but that is another matter altogether). They also confirmed that there were no 'discrepancies' with the item whilst in transit suggesting that it weighed the declared weight, was not smashed and leaking in transit, and that the buyer confirmed delivery and signed for the parcel. They have decided that they are not going to refund the buyer as they believe the parcel was delivered.

They have also advised that they will not compensate even though we the seller insured the item to it's value. What would you guys suggest in going forward from here? How would eBay likely resolve this if it went to dispute? I asked AP how they could come to this conclusion when it is the buyer's word against the delivery driver and they quoted the above that they had delivered the item, it was signed by the buyer and no damage to the item had been marked on the parcel when in transit. Any advice greatly received.

Did AP email you this investigation outcome, or did they tell you over the phone? If it's the latter, ask them to send you an email with that information - specifically, the part about there being no evidence of tampering or discrepancies. Don't show the AP email to the buyer yet, if you haven't already.

In this situation, I would:

1. respond to the buyer and say that Australia Post have indicated that there was no discrepancy between the lodgement weight and the weight in transit, and that that indicates that the item was removed from the box around the time of delivery, not before. Act as if you're really outraged that someone has "stolen" from your buyer, but also act as if you think a third, unnamed party is to blame (eg: someone other than the buyer because they'll get defensive).

2. ask him for the case number of the police report he filed, and the police station he filed it at, and say that you intend to call them and forward them the email that AP provided you with. If the buyer suggests that you give the AP email to him to give to the police, insist that you want to do it yourself because it'll be better if two of you are involved in the report so that they take it seriously, and also that, because the email was sent to you, you need to be the one give it to the police.

This should scare him off if he's being untruthful and fishing for a refund. However, if he readily provides the case number then I would call them and ask if a report was actually filed, and if so, then he's probably telling the truth.

Advice Please

Hi guys,

I hope you are all well. I have just received a message from a buyer stating that they have received a parcel I sent on Tuesday but without the actual item. The lodged weight was 1.8kg and I remember packing this as I have had very few sales this week. The item was certainly in the box as I had 3 of these in stock all lined up next to each other and now I have two next to each other. I take great care in packing my items so I go through a process and remember going through that same process packing this. I also have to weigh every package as they always differ because my items are all different and sometimes I use packing peanuts and others cardboard fill.

The buyer is claiming that the parcel arrived weighing only 492 grams and sent through images of the box with the packing materials inside. The thing is I know Australia Post have been getting ever more strict recently with measuring and weighing parcels so I am hoping this time they have also weighed this one. I have replied saying that I am sorry they have had this experience and that I may need to lodge a Police report and also lodge an enquiry with Australia Post. I know for certain the item was packed and sent.

Any tips you would suggest? The buyer opened his message with 'Hi. I am impressed by your 100% positive feedback rating. I'm also impressed by the early arrival of my package. I'm not quite sure how you achieved this rating." this raised some flags for me as it suggests I will be scared about the feedback. I know this could just be an upset buyer though. Any ideas on how to proceed?

Hi, thanks for your reply. Yes, all my items are tracked, fully insured to value and require Signature on Delivery as they are alcohol. Buyer claims that package did 'not look like it had been tampered with'.

Do you think the buyer is fishing for some type of refund since they can't claim that it wasn't delivered?

What is their feedback left for other sellers like?

Also, isn't it prohibited to send alcohol unless it's going by rail or truck? Do you have to have a special licence? Could be wrong though.

As twyn suggests and check the buyers feedback, both feedback left and received to see if there are any signs of aggression.

What is puzzling is that the buyer doesn't tell you if the package appears tampered with, and as you suggest seems to immediately attack rather than think the item has been stolen in transit.

Feedback all seems ok. I always check a buyers feedback as soon as a sale comes in to see what I may be dealing with. Their feedback for others seems ok, perhaps with a few that might suggest there has been some 'negotiating' but nothing obvious. I agree, I was a little surprised that 1) they mentioned my feedback and that they are not sure how we have that rating, and 2) That they imply that the likely scenario is that we did not put the item in the box, not that it has been tampered with.

My fear is that the buyer will refuse to take to the Post Office which it seems is an Australia Post requirement nor lodge a Police Report? The hope is that given AP are becoming ever more strict with the dimensions and weight that they are checking each parcel?

Thanks for your input. It could be possible that because we pack our items so well that we have eliminated many of the ways that a buyer could get a refund. By this I mean we have to send with signature on delivery, they have to be tracked and we pack our items at least as good as the very best alcohol retailers as we always use bubble wrap no matter the value of the item. Many retailers just send in a box and hope for the best. It may be that the buyer had hoped we did not send with signature on delivery (some alcohol sellers do not do this) and/or hoped they could claim damaged bottle but then seeing how we send knew this would not work so is claiming that it was not in the box.

Unfortunately not. We do all our labels on the Australia Post MyPost website. But we always have to weigh each parcel even if it is the same item because the void fill materials changes and sometimes we wedge the bubble wrapped bottle with cardboard of different thickness and weight to ensure no rattling and movement therefore they weigh different amounts.

Yes, I also find the language strange but I suppose it could be that they genuinely feel they have been wronged and are using subtle threats as a means of getting a good outcome. I have had this happen only one other time but that buyer was a Policeman and he could see the parcel had been tampered with. To be fair to this buyer now, I suppose if he is a frequent online buyer they may not have known which parcel this was until it had been handed over.

At this point the buyer has not made any demands or nor have they opened a case but perhaps if they are not legit they were hoping we would refund to save our feedback. Sadly when I lodge my parcels they just scan them into the system but I am hoping that they have weighed this at some point in the system.

The buyer seems to express himself in a slightly weird way, but this doesn't necessarily make him a scammer, and he doesn't seem to be angry either. If he has opened a case with AusPost without even telling you, he might be genuine, even if I don't understand why he accepted the parcel if it was obviously too light, but maybe the parcel arrived with other parcels or he just didn't think about it.

I have occasionally received parcels that were not perfectly sealed because the tape was not so sticky any more (maybe due to humidity sometimes?), but luckily they were not empty.

I understand you do your own Aust Post labels - but you should also have a receipt from when you lodged them at the PO - all my receipts have the postage range - maybe you will be lucky and have the actual weight.

Recently I have not been getting the lodgement receipt as I have built up so many Australia Post receipts that I started to say no when they asked if I needed the receipt, and given there is the record through My Post Business I thought that may be sufficient. However, I think I need to go back to receiving the receipt. This morning I told the AP PO person what happened with the parcel in question and asked her to confirm the weights with me as she scanned them. I may need to do this from now on to have them sight the weight and keep the receipt.

Not sure but maybe the new Aust Post policy might work in your favour - if they weigh the package as they say they do during the sorting process, maybe there is some record somewhere of the actual weight?

As a parcel travels through our network, it’s checked by scanners that form part of our automated sortation process. This allows us to measure and record the parcel’s packaging type, dimensions and weight. The equipment that we use has been certified as Legal for Trade by the National Measurement Institute of Australia and enables us to charge you accurately.

The parcel details detected are then compared to what was declared when the label was purchased through MyPost Business. Underpaid postage will apply if there’s a discrepancy
