      <description>&lt;P&gt;I am arranging a return with a buyer for an item that was damaged in transit. The buyer has also lodged an&amp;nbsp; ' item not as described' case because the item was damaged. Um if the item was damaged in transit of course it's not going to look the same as picture in listing? Am I right? Should they be able to do this?&lt;/P&gt;</description>

      <description>&lt;P&gt;Yes, sure they can do it. And why wouldn't they?&lt;/P&gt;&lt;P&gt;It is no longer as described, it is damaged. If I were the buyer, I'd be doing the same.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I know it was probably perfect when you sent it and you didn't personally damage it but it is your responsibility to get it to the buyer undamaged and if that doesn't happen, you need to fix things up. Sometimes that is with a full return and refund, sometimes they may be happy with a partial refund if they can keep the item.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I know it hurts but just do it, issue the return label if you want it back and when it arrives, refund.&lt;/P&gt;</description>
