From November 1st 'Buyer remorse' as a reason for return will all but cease to exist.

Option A. Pay to return a 'change of mind' for an item cost refund only or

Option B. Get out a microscope, find something significant ( under high magnification )

and have the seller pay everything back AND pay for your return 'online trackable' postage.

I'd be curious to know if eBay will track how many buyers backtrack from a 'change of mind' reason to an 'item not as described' reason if they see they'll have to pay for postage.

Also, I think if we as sellers are going to keep advertising what I presume will become eBay's veritable "no questions asked money back guarantee", we may as well make it our marketing strategy.

One of the more interesting aspects is that buyers will be required to return an item

to the 'item location' as per listing. This is a good thing and will certainly slow down

off shore sellers advertising 'local' item locations.

The notion that ebay, if asked, will investigate SNAD claims is logistically impossible unless

the investigation result will be be based on the toss of a coin.

Maybe Emma will be dragged out of mothballs...lol

digital*

I have talked to someone from Denmark and England few days ago - and they were saying that "buying on Ebay" and Ebay in general are a laughing stock over there!

Returning items is rife, very easy and convenient - no questions asked - and not a single person aparently has ever been questioned by Ebay over their activities.

One lady was saying that even nice people, those who'd never even consider taking such a blatatnt advantage of anyone are doing it - just because they can!

Human nature is such that if something is handed out on the platter - we take it.

The most and easiest merchandise to do it with is:

* Electronic devices

* Books

* Clothing and shoes

* Videos & CD's

* Jewellery & watches

These are the items that can be used, watched, read - and then returned, and all that within 6 months!

They also told me that Ebay is rapidly becoming a most hated company in the world. From the seller's perspective, of course.

I'm also just wandering what happens with all FVF's when the full refunds are issued, does the seller gets them back or they loose that as well.

The seller does not get back the FVF on the money back guarantee deal.

Most O.S sellers have a re-stocking fee in their conditions which is taken from the refund amount.That is the only way to recoup losses from change of mind returns.

OMG narelle.

No fvf refunds means essentially that despite what ebay might say about

deciding cases, there is no good reason for them to decide against a buyer.

IF fvf's were to be refunded then maybe ebay would put up a fight on behalf

of sellers ( to protect their fee income ).

This re-stocking fee angle seems like the best way to go but I haven't seen

mention of it in all the new rules. Have you ?

It 'appears' that restocking fees can only be charged on new items as far as ebay Australia guidelines are concerned.

'although for "change of mind" returns you may specify that items must be returned in original condition or charge a restocking fee for items returned opened or used.'

To assist you, we have set out below the Dick Smith Returns Policy highlighting key points that you should know.

1. Australian Consumer Law

Our Returns Policy includes, and does not seek to exclude or limit, the rights you have under the Australian Consumer Law (if you are a consumer) and other relevant laws.

If you are a consumer under the Australian Consumer Law:

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Your rights under the Australian Consumer Law are not limited by a defined time. However, the Australian Consumer Law does recognise that the relevant time period for which a remedy may be available can vary from product to product, depending on factors such as the nature of the product and the price. Dick Smith adopts the same approach. As you can appreciate, the type of remedy we can offer you may also vary depending on how long it takes you to return the product to us.

Anyone think eBay is going to get away with Money Back Guarantee under Australian Consumer Law.

Begs the question of a case for an item purchased 6 months ago - being returned WHY & WHY did it take so long etc.

Don't think so - especially for good etc that are determined vintage, purchased as used items, is jewellery going to have a major failure.

In a lot of instances these days nothing is expected to last 6 months.

helen,

I'm sure all sellers here would wish that Aust. Cons. Law is going to protect them agains unjust claims.

But sadly - that is not the case.

I spoke to them at length recently about some other matter - and just happen to mention few new Ebay's conditions on selling.

The answer was a very resounding - no protection at all.

As they (Ebay) are an of shore company, and also as all sellers will have to sign the new agreement agreeing with tose terms - Ebay is home and hosed, as they say.

To do exactly what they want.

And history has shown that they will not be able to "process" all claims in order to retain fairness, even if they wanted to - so the long and the short of it will be - refunds issued to just about anyone who squaks - and seller being notified after the deed was done.

And then a total stonewalling if one tries to correct the mistake - long and frustrating process that ends with the brick wall.

Sellers do have the choice - only one , it seems - not to deal with them

And buyers, such as myself - have heaps of other choices where to shop - Ebay is not the only shopping place on Earth.

I can't be sure, but the items that I buy are all in the high risk categories, outlined in the previous post, and it just makes me wander if there will be enough stuff to buy - once sellers start to get burnt and leave.

Since I sell mainly clothes and shoes - at least half of which are secondhand - the new ebay rules will probably be the end of selling here for me, at least until I get slugged with a claim for either INR or INAD. I cannot replace my items - they are one-offs - so any claims would have to be refunded. I make little enough on my sales already to even contemplate refunds.

I think a combination of Clarry's suggestion (in another thread?) about getting the PO to sign a Lodgement Receipt Form every time you post an item - to circumvent any INR claims - and your suggestion of some sort of tamper-proof tag - to circumvent change of mind claims - PLUS being super scrupulous in descriptions with lots of supporting photos - should just about cover all the bases.

Just going to have to put my thinking cap on about the best sort of tags to use, or at least my googling ability 🙂

I feel sorry for people selling wedding dresses, whether they be new or second hand. Buyer buys the dress for their wedding, has their wedding, no longer has a use for the dress, so demands a refund. Try and tell me people won't try and pull that stunt, especially if they pay a lot for it.

What on earth do we do? This is scaring me so much. I just want to ring ebay and scream. Is there another site that we can sell on that would be as popular as ebay without all the **bleep** going on
