Yea I can share especially now I may have a small victory but will wait and see how it pans out!

Its my air mail customer from earlier in the week. 3 or 4 messages a day long story short she is after a freebie.

she opened a ebay case saturday morning closed it saturday arvo with a follow up message if you wont reply I am now opening a paypal case will get the item and my money back.

Numerous times offered to pay return postage even told her I was sending her an envelope addressed and postage paid to which her reply was fine and if its not accepted by post office will be back in touch with u now leave me alone??

I spoke to ebay today who told me no tell her to send pictures of the item where its not as described if she cant she can keep it 🙂 WOW YEAAAA

So I did instantly she said paypal are now dealing with it leave me alone and opened a paypal case...........

So I rang paypal who said so you are happy to refund her ummmm yes benn saying that for a couple of days now however I am NOT paying more for postage than the item in total is worth like she claims it will cost me.

OH ok no problems we are deciding in the buyers favour HOWEVER she will need to pay return postage to send it back to you 🙂 woooo

I'm sure someone will correct me if I'm wrong - but I understood that if a buyer opens a case through eBay, then they cannot subsequently open anything with PP.

It should count because it's written in the MBG policy that if you open in one, you can't then use the other. At least by going through PayPal, she has to pay the return postage, so she's the one who's going to lose out in the end. I wonder if she thought of that before opening that dispute? She would have been far better off leaving it with the eBay dispute.

Have you left feedback for her? If not, wait until you get the item back, then leave feedback mentioning that a refund was issued. Something along the lines of "refund issued <user ID>. Thank you". That way it's a positive comment and everyone else will be able to see who it is. Other sellers in the future will also be able to see that she has been given a refund and see if there are any patterns forming when she tries to buy off them.

I agree with you that it is in the MBG policy, and should count. The fact that the buyer closed the case should be an irrelevance.

Or does that mean that there is a big hole in that policy? A loophole that eBay haven't advised about?

Buyers can't use more than one resolution method to get a refund. After selecting a resolution process (eBay Money Back Guarantee, PayPal Buyer Protection, or requesting a chargeback from their payment provider) a buyer is required to use only that process to resolve the transaction issue.

I was just thinking that PP should be telling that buyer she has no case at all now.

Opened and closed a case with eBay - there should have been some block in place to advise her that there were no further options.

Sort of makes me shudder to think what possibilities are open to 'buyers' (and I use that term loosely), when one door has been opened and closed, that the other one opens and says 'come on in'.

What hope have sellers got if that is allowed to happen?

Hmmm mayb I may ring paypal back and tell them that then. I assumed as she had closed one she was still able to proceed with the other. oh and of course now i have the neg feedback she left me although one comment was slow delivery when the item was delivered within delivery times so I may also ring ebay and ask them to remove that neg

I have that option dont I?

Sorry also that is EBAYS policy not paypal so looks like she can close ebays claim and file with paypal but not the other way around plz someone correct me if Im wrong..

its in paypals ToS under limitations section S13.1 (b)

So no, she can't close the claim she made through eBay and then file with PP.

And if she can, whoah!! that makes a complete mockery of the policy.

I think you are being taken for a sucker by PP and your buyer. Stand up to both of them.

Tell PP that she opened a case with eBay, therefore she cannot open a claim with them. I don't think it matters that SHE closed the case - the bottom line is that SHE DID OPEN A CASE WITH EBAY - and their policy quite clearly states that she is required to use one process only.

S17.1 You may not file a dispute or claim or receive a recovery for a purchase under the PayPal Buyer Protection Policy if you have already filed a case with or received a refund for that purchase directly from the seller, eBay or another third party.

I would definitely be ringing PayPal and telling them that she has already opened and closed a case with eBay. Quote their own policy at them if they refuse to budge. There have been buyers on the buyers forum who have made that mistake (closed an eBay dispute before resolution) and didn't have a leg to stand on. There was nothing they could do.

I would also be ringing eBay about the feedback if you have a tracking number that proves the item arrived within their estimate.

It seems lately, they (eBay) are just making up and changing rules as they go. These boards are evidence of that. Constant inconsistencies ! It's happened to me. On one occasion they remove the unfair defect, second time, even with a message from the buyer stating it was an error - no go - they refuse to remove ! They are pathetic !!

Good stuff!!

I thought there MUST be something that should cover this area. Otherwise it would be open slather on sellers whichever way they turned.

They're getting a hard enough time of it as it is, since the MBG, PP extended claims, etc. etc. came into play.

It would be nice though if both eBay and PP abided by their own rules, without sellers who are having issues, having to spend an inordinate of time pointing out to both entities what their policies actually state.
