I recently contacted a seller about a "New iPad mini 4" and he confessed it was "and old listing" and "It wasn't avalible" why is that allowed on eBay? there's no catergory for "item unavalible" and why do people do this? Does it avoid eBay fees by not removing your listing or something?

No, they can't avoid fees by not taking down a listing. Ebay knows when something is sold and charges fees immediately. Just realize that some people are lazy, or inefficient or both. He probably still has not taken it down. Find another seller.
