Help please with EPA

I know someone who has no-one to name as Enduring Power of Attorney.  Her retirement home is requesting a copy of same when she moves in.

 

Does anyone know what does someone does in this case?   I didn't think is was compulsory to have one.

Cant she appoint a solicitor? Its probably not compulsary, but definitely recommended.

 

Over the last 12 months I've wondered what the hell I would have done if dad and grandpa hadnt appointed anyone power of attorney, it has made my life so much easier when both of them suddenly were unable to look after their affairs.

 

The retirement home probably just want to make sure they'll continue to get paid if something unforseen happens to her.

I think a solicitor would be cost prohibitive, and a solicitor doesn't have dealings with doctors, etc.

 

I'll try to find a government department for her to get sone advice.

She can appoint the Public Trustees as she guardian.

Enduring power of attorney
And guardianship
Are three totally different things .

Power of attorney
Gives the holder a limited ability to deal with the financial decisions of the person who has signed them over to the trustee and is usually only for a limited time or specific function ie a solicitor can be granted a power of attorney to a purchase property On behalf of a client it does not give them power over all the persons finances but does commit them to the specific act in which the trustee ship/ poa was set up.

Enduring power of attorney
Give the trustee total control over the all financials of the person signing the EPA theses are usually set up for elderly or the sick who may at any time become unable to coherently manage their own finances , extreme caution should be used when writing up an EPA as a poorly worded one can be used to take over the controls of the person before they are ready or in need of them.

A guardianship
Is a person who is appointed to take control of all non financial aspects of a persons life , when they are dreamed no longer able to make these decisions for them selfs ie medical decisions , housing decisions etc.

In all cases extreme caution in choosing the person to control the decision should exercised and even the choose of having 2 or even three people to act together is recommended so as to avoid the manipulation of a person life for personnel gain

Thank you Kilroy.  I am aware of the differences, and it is not an adult guardian she is wanting as someone suggested.  It's an EPA she needs for the future.  She is not ill yet.  She simply has no-one that she can ask to take on this responsible job and I don't know how to advise her.  It can't be the Public Trustee because they (as far as I know} do not deal with doctors and hospitals.
