yes, it is but that does not assist someone if another driver is at fault and damages the other person's car does it?

Who ever is responsible for the accident pays.  If they have 3rd party property insurance their insurance will pay.  Some 3rd party property also have basic cover for theft & fire.  But some do not.  If the person who caused the fire is caught he may very well be sued, and if he owns property he may loose it.

My daughter's car was hit by an unaccompanied learner, no insurance.

The police said, no point suing her for the money, she has no job or assetts, would cost more than damage is worth.

Fortunately daughter's car has comprehensive insurance and she could id the other party.

if he is sued, wouldn't they have to establish that he owed the people a duty of care?

How would reasonable forseeability apply to those specific people?

Some people can go their whole lives and never really live for a single minute.

The fire weather warnings on the day should have been enough to stop anyone smoking outdoors and throwing their butt into dry grass.

BTW throwing lit butts is something you can be fined for.

I thought you can get fined for littering if you drop as much as bus ticket.

And yes, the first step if sueing somebody is to make sure they do have assets.

A few years ago when there were bushfires close by, I was driving behind a car and the driver threw out a lit cigarette butt then went

for approx 10 metres and turned into a driveway.  Took note of the rego number and phoned the police.   Went past a few days

later and the car is parked there.  Obviously his home.    Couldn't have waited till he got home to discard the cigarette.  Very irresponsible, when there are bush fires burning approx 5 kilometres away.
